Washington Alliance of Tech Worker filed an appeal of the court’s decision|
The Tech Workers first argue that the lower court did not have jurisdiction to grant the May 10th extension because the case was pending at the appeals court. They argue that the only way for the lower court to grant the extension was if the appeals court first remanded the case back to the lower court.
Second, the plaintiffs argue that the lower court abused its discretion in granting the extension for three reasons. 1) no “regulatory gap” actually exists, 2) the extension granted under subjection 6 of the Federual Rules of Civil Procedure is barred because subsections 1 through 5 applied, and 3) there were no extraordinary circumstances.
