H1B超6年 + PD current近3年未交485 + PERM认证9月中作废，还能transfer+extension吗

前前公司的140还没撤销其实已经是很重要的底牌了，但PD已经current快三年，这跟普通拿着140续H1B的情况确实 ...

我认识有的pd current 4年的都有。没发现什么问题。跳槽以后拿到的485。

也报个dp，pd current不到一年，今年4月份file h1b extension，但是当前公司（就是Google）仍然不给file perm，导致h1b extension rfe后被拒，现在只能转H4。

啊，不是说Google已经开始恢复perm了嘛，这也能拒。。。

“Google已经开始恢复perm”这话我两年前就听过了。

开始恢复perm 不等于 恢复perm
恢复perm 不等于 perm能办得下来

你的 PD 已经 current 超过一年，但这期间没有 file 485。法规里对这种情况有一个限制，但同时也有例外：如果能证明没有及时递交 AOS/IV 是 due to circumstances beyond your control，USCIS 可以酌情 excuse。

8 CFR 214.2(h)(13)(iii)(D)(10) 原文是：

“An alien is ineligible for the lengthy adjudication delay exemption under paragraph (h)(13)(iii)(D) of this section if the alien is the beneficiary of an approved petition under section 203(b) of the Act and fails to file an adjustment of status application or apply for an immigrant visa within 1 year of an immigrant visa being authorized for issuance based on his or her preference category and country of chargeability. If the accrual of such 1-year period is interrupted by the unavailability of an immigrant visa, a new 1-year period shall be afforded when an immigrant visa again becomes immediately available. USCIS may excuse a failure to file in its discretion if the alien establishes that the failure to apply was due to circumstances beyond his or her control.”

所以这个案子的重点应该是解释为什么你不是“不想递”，而是客观上没有一个可以合法承接 485 的主体。比如前前公司 job offer 已经不存在，现公司虽然 PERM 批了，但公司裁员后明确不继续 file I-140，导致你在 PD current 期间实际上没有可用的绿卡载体。

这个 beyond your control 的论证会非常 fact-specific，要看律师怎么写解释信、能提供什么证据，也要看移民官是否接受。如果新公司和律师愿意尝试，我觉得可以把“承接主体缺失”作为核心解释方向来展开。但是否能过，还是要看具体材料和 officer 的判断。
