请教NONCOMPETITION条款，很迷

公司需要签NONCOMPETITION条款，新人表示很迷，没太看明白“
                                                                                                                                                [size=12.000000pt]I agree that while I am employed by the Company and for a period of one year after the[size=12.000000pt]termination of such employment for any reason, I shall not, without the Company’s prior written[size=12.000000pt]consent, directly or indirectly, develop, design, produce, market or sell (or assist any other personor entity in developing, designing, producing, marketing or selling) products or servicescompetitive with those developed, designed, produced, marketed or sold by the Company. 条款中并没有明确说是什么公司。。难道所有的科技公司都会波及吗？还是什么公司都不会被波及囧

                                               

這是很standard的 noncompeting agreement。一般來說，像我這小角色，老僱主也應該沒有時間去告我吧？告我要花一筆錢啊，我又不是Anthony Levandowski （Waymo vs Uber），誰烏我跑到 MW的對手？正常來說，這種東西主要是規管高級的員工。。。

但在加州，noncompeting agreement is not enforceable。

但也有些公司偏偏要搞死你，誰也擋不住。所以簽之前，最好要想想自己將來發展的方向。比方說，你專長是自動化汽車，那麼這個contract你要好好考慮，要請個律師給意見。
