纽约 H1B Extension Deny - H4 - H1B Refile / Change of Status

最新的律师的说法是 我H4回来之后。
1. 可以选择 H1B refile. 这个approve之后 我要回一趟中国 才会正式生效。
你已经拿着H-4回来了，就file change of status就好啦，为什么说你必须还要回国一趟呢？~~让我想一下，律师可能是想说，在你这两天离境之前就file 上去，那么因为只能申请cp，所以过两天即使你拿了H-4回来，approve之后一样还是要回国激活~~但是这不是大前提里你说“H-4回来以后”的事了呀~~既然H-4回来之后才file，就直接file change of status不就好咯，就不用出境面签了~~
拿着H-4确实可以让你自由往返中美，这没什么问题，而且也确实像你说的change of status批准了以后出境还是要拿visa回来~~但是关键在于我认为你的律师如果一定要等到你拿H-4回来才file H-1B，还告诉你必须回国激活是不对的~~要么就节省一些时间在你离境前file H-1B cp，要么就等你H-4回来再file H-1B change of status~~
人不在美国境内也是可以申请H-1B的，因为不需要change of status所以不用填合法身份的问题···总之，我认为你的律师很混乱···

我的律师是这么说的：
Q: Once H4 visa is approved, do I have to physically be in United States to start my H1B refile / change of status? The petition is already in preparation, but we can only file with USCIS once you are physically in the U.S.

Given that your I-94 expired in July and your pending extension, which was your only basis for remaining in the United States, has been denied, you cannot remain in the country. Your only option for applying for the H-4 is to apply for the visa at a consular post abroad; you are not eligible to file for a change of status from within the U.S.   



As we discussed on the call yesterday, we can file your petition for consular notification before you return to the U.S. on the H-4 or we can file as a change of status after you have returned. If we apply for consular notification, and the petition is approved, then you would be required to travel abroad again, apply for the H-1B visa, and then only once you have re-entered the U.S. on that visa could you rejoin the firm. If we instead pursue the change of status case, then you would not be required to travel abroad again in order to resume employment.

她给我的说法就是 要么H4回来再弄 / 要么现在开始h1b refile 回国等半年。
对 我就是觉得我的律师不让我申请H4的时候 同时此刻帮我 refile H1B, 而是要等我回来才开始弄。减少了一个缩短时间的可能性。

I got the big picture. That's why I am asking to file my petition for consular notification even before I return to U.S. on the H4. I can travel abroad again for H1B visa interview and get a visa stamp because I will need to do that anyway in the future. I just want the H1B refile start as early as possible.

Please advise if the firm can refile my case now. I don't have to wait for 6 months outside of U.S. if my H4 is approved. I can come back on H4 and wait for approval. Once H1B extension is approved, I will go back China and have my visa stamped.

我其实是想要这个效果 同时开始进行。 我们公司现在有两个律师。 一个组里的律师 一个专门做移民的律师。 互相的理解都不一样 组里的律师只会重复移民律师的话 反复告诉我有3个选项。 如果不想中国等6个月。 就一定要H4回来后 再开始弄H1B.

如果这不是公司的意思，说必须看到你回到美国了，还有决心留在公司工作，那么这句话是不对的···人在任何一个国家都可以file H-1B~~而且和他第三段的话矛盾，他自己都说了如果consular processing你需要出境再签回来才能入职，如果等你H-4回来file H-1B， 就可以直接file change of status，不用出境激活
第二段话没有问题~~
你给律师的回复我觉得挺清楚的，就是告诉他希望在你办H-4的同时file H-1B~~你都告诉他你不在乎是不是还需要出境签了，他是觉得你准备在file cp之后，你拿了H-4回来，批准后你就直接回去工作么？···我不知道他在担心什么···
另外，谁告诉他如果你不H-4回来就必须在国内等6个月，你在哪儿等、以什么身份等，如果没有PP都是6个月好么？···难道你拿H-4回来办change of status，没有PP就不用等6个月了么？···难道办理H-4用的时间加上用H-4在境内等的6个月的时间不是更长么？都不会10以内加减法么···看着你的律师好生气啊···

这律师把我搞得晕头转向的。连续2封确认信 + 电话留言。 终于给我确定可以开始H1B refile 了。 打包周日回祖国怀抱签H4. 谢谢妹子哈！思路清晰 有专业知识 好厉害！
