你是今年新抽签？那说明biometric安排得很快啊。。。。我之前以为我很快收到了biometric的通知是因为我们PP，看来NON-PP的也很快收到了biometric的通知。。。H4这么一要求打指纹，就从PP里踢出去了。regular pool不知道要等多久，也许刚好拖到H4 EAD被取消？？？呵呵呵呵呵哒，好气。

My lawyer told me do not apply for H1B EAD unless you have got your H1B for 6 years and file the extension. Or you will have endless trouble on your green card application.

I do not know if it is true....

额。。。如果H1B未超6年或者140没有approve，本身就不满足申请H4 EAD的条件呀。。。。

H4 可以申请EAD的条件需要H1B满足以下之一：

1. H1b受益人已经拿到approved 140，or
2. H1b受益人已经被approve六年以上的第七年延期

是吗？？？官方文件里好像没有看有什么额外的风险呀，有approved 140，你是approved H1b, 你的配偶就可以申请H4 EAD。不知道你律师值得永无止境的麻烦是什么。。。。

但如果我是你的话我肯定是想试一试的，在这个H4 EAD有可能被取消的节骨眼上，你满足所有官方要求的条件，为什么不申请试试呢，最坏的结果就是EAD没有下来，也不会影响你们的H1b和H4呀。

That's exactly what I think. My lawyer is super super cautious and old fashioned........Anyway I think you are right. It worthes trying. Thank you! Wish your H1B get approved soon!

你去研究一下I-765表格的那个instruction，我昨晚研究到凌晨。。。这是官方解读，总没错的，大家讲道理嘛，你规定了，我符合规定了，为什么不可以？

如果律师很反对，这个完全可以自己DIY，需要提供什么文件I-765 instruction 写的清清楚楚的。祝好运，我也在努力爬这趟末班车。。。

I also have read two times and think we are eligible for application.

Thank you so much and hope we will get want we want. It is a long torture for EB2/EB3 application. All of us are our heroes.
