和小区签了明年的lease

因为疫情加上年底毕业 我想现在把明年的lease取消 我和小区说我愿意支付罚款 但是小区的回复是 需要支付两个月的房租加上找到新住户 我才能取消明年的lease

这样会不会有点霸王条款 要怎么解决

要不就是搬走额外付两个月房租（不费时间精力找人），要不就是找到人sublease然后他/她付房租，你这个需要两个都做，真的是太坑太黑了，怎么还没倒闭。

如果你当时签约的时候里面就是这么写的 那leasing Office就有权跟着合同走 之前我也被坑过很多次

RELETTING. There is no early termination clause in this Lease Agreement. You will be liable for a reletting charge equal to two (2) months market rent if you (1) fail to move in or (2) move out without our prior written approval, or (3) are judicially evicted. The reletting charge is not a cancellation fee and does not release you from your obligations under the Lease. It is not a release or a Lease cancellation fee or buyout fee. It is an agreed-to liquidated amount covering only part of our damages, that is, our time, effort, and expense in finding and processing a replacement. These damages are uncertain and difficult to ascertain – particularly those relating to administrative and marketing costs. You agree that the reletting charge is a reasonable estimate of such damages and that the charge is due whether or not our reletting attempts succeed. The reletting charge does not release you from continued liability for future or past-due rent, charges, fees or other sums due under this Lease.

是有点 因为Office给的回复是

You will need to pay the relet fee that is equal to two months of your rent. You are responsible to find the person to take over your lease. The relet fee will need to be paid in full before the person you found can apply and sign. They will also put through the screening process like a normal lease. If you find someone, please let us know their name so we know they are to take over your lease.

不错了，我们小区是不允许转租，搬走可以，房租照付。

楼主在加州吗？如果是，请参考Civil Code section 1951.2，加州法律不允许房东收取提前退租的惩罚。相反，法律规定房东必须积极重新出租该单元以减少损失，并仅可追偿实际损失（比如空置时间损失的房租）。

两个月罚款一般都是 招新人有点坑 看合同了
