比如作为一个善意提醒,而不是注册个三无小号开口就是质疑/否定/自认是authority,我很愿意跟你讨论这个法律问题。
本贴情况可以参考AC61-142:
其中的7.1.2 Pilots must be aware that, unless an exception applies, any operation that meets all the elements of common carriage—i.e.,(1) a holding out of a willingness to (2) transport
persons or property (3) from place to place (4) for compensation. This "holding
out" which makes a person a common carrier can be done in many ways and it does
not matter how it is done. Therefore, private pilots who want to share expenses under § 61.113(c) must not "hold out” to the public or a segment of the public as being willing to furnish transportation to any person who wants it.
这里的1的hold out的williness,包含2/3/4:即愿意让搭乘任何人/财产,从某地运往某地,以换取报酬。这里FAA怕说不清楚,还补充了一句"must not "hold out" to the public or a segment of the public as being willing to furnish transportation to any person who wants it. "也就是说完成他人向private pilot索取的任务。将这句话拆开理解,比如认为“在网站发帖”满足1,transport了狗满足2,分摊收益满足4的这种理解是与这句话冲突的。
为什么此贴不符合7.1.2中的common carriage:1. 并不是完成搭乘者的任务,而是搭乘者配合我完成救援任务,任务本身是我寻找的,搭乘者也不能指定我的任务。简单来说,无论是否有这个搭乘者,我都会去救援狗,因此并不是我去满足(furnish transportation)搭乘者的任务。
2. 并不是所有搭乘者我都会接受,你感兴趣了,申请了,还要符合我自身的计划,才能搭乘。
因此这里不符合7.1.2的情况。
FAA为了怕讲不清楚,对common carriage有分歧,还补充了7.1.3,专门告诉你怎么判断common carriage的简单原则: ....For this reason, in assessing whether a particular operation involves common carriage, the FAA has consistently interpreted § 61.113(c) to mean that a private pilot have a common purpose with his or her passengers and to have his or her own reason for traveling to the destination. The
U.S. Court of Appeals for the District of Columbia Circuit affirmed this interpretation and recognized the FAA’s “common purpose test” as a limitation on the expense-sharing provision of § 61.113(c).
也就是说,pilot必须决定去哪儿,而且分享expense的人必须跟pilot有同样的目的。在这里,很明显我的目的是救援动物,乘客跟我的目的是一致的。
这里还专门说明了,巡回法院确认了“common purpose test”是用来判断是否可以分摊开销的办法。
综上,在AC_61-142没有被替换之前,本帖的活动完全符合61部的法律。
