我查了一下原文是
the Labor Certification or I-140 was filed at least 365 days before the end of the sixth year or the requested H1B start date
我感觉并不是说PERMpending超过365天
麻烦有知道的大佬也提供些信息，谢谢！

不知道你哪里看的这个，移民局手册是要求Pending或者approve(180天内)

extension request:
· 365 or more days have passed since the filing of any application for labor certification, Forms ETA 750

obtain status as an EB immigrant; and the labor certification, if approved, has not been revoked, is
unexpired or has been timely filed with an EB petition within the labor certification's validity period; or
· 365 or more days have passed since the filing of an EB immigrant petition that is still pending; or
· The alien is the beneficiary of an approved EB immigration petition and is not able to file to adjust
status to U.S. permanent legal residence based on the unavailability of an immigrant visa number.




要是不要求pending/approve H1B第一年随便file一个被拒的PERM岂不也能无限延期。。。而且也没有你说的往前推，就是按照file日期往后算365天，不是H1B结束往前推365天

大佬，那我做h1b recap你知道具体有什么要求，要怎么做么？直接让律师按照我之前处境记录等文件，可以就提交一个h1brecap request? 然后USCIS 给我发新的I797和新的I94？还是说只有我做h1b extension的时候，才能顺便recap？如果是只有做ext的时候顺便recap那我就凉了……

大佬，在你提供的这个uscis的文件里，下面还有一条关于365的解释，你在文件里搜索一下看看，我感觉是我说的那个意思。

Assuming the alien is otherwise qualified for an extension of H-1B status, USCIS will grant an extension
beyond the 6th year if evidence is provided that:
· A labor certification is unexpired at the time of filing of the Form I-129 H-1B extension petition; and
· The labor certification was filed with DOL or the Form I-140 petition was filed with USCIS at least 365
days prior to the date the alien beneficiary will have exhausted 6 years of H-1B status in the United States
pursuant to section 214(g)(4) of the INA; and
· The extension and the I-129 petition are otherwise approvable.

recap就是extension，一样的，给律师你最近几年的出入境记录

你现在这个时间线再extend也来不及，不如早做回国的打算，实在不想回国就去办个加拿大签证去加墨或者加勒比

大佬你看我之前的回复，在你提供的那个uscis的文件里有关于我说的那个6年到期前365天提交prem可以做h1b extension的

我就是你的翻版，不同的是，我H1B 在上个月10月底max out了，我选择在美国境内等。 在这边等，唯一要处理的就是合法身份（方式很多）， 回国了 ，不光要跟签证官打交道，不确定因素还有，航空公司，疫情政策，海关边检等等等等….

建议立刻联系律师，走O1或者EB1a， 最不济B签也能扛几个月，希望你能顺利拿到I-140

感谢大佬的信息和回复！我的问题就是什么都不能转，O1或者NIW都不符合条件，是个小混子……

我是完全没有经验，百分百信任了律师，以为八个月时间perm怎么也够了，结果眼睁睁看着就max out了，最后一点办法没有

补充内容 (2022-11-13 05:29 +8:00):
回国考虑过，但觉得不可想象，天天核算，搞不好长期隔离，随机封城封小区，异地旅行各种政策，电子镣铐，还要给国内家人造成巨大的麻烦............

特别理解，回国别考虑了，多资讯律师尽可能在境内等身份。 花点钱 都是小事，搬家啥的很大概率就回不来了。

我eb2，老婆学钢琴的，很弱的case，勉强把eb1a资料交上去。 过不过的都不期待了，起码给我买了很多时间等待eb2审核结果
