USCIS: H1B 10万美金新政，适用于any new H-1B visa petitions？？？？？

之前大家好像都在说境内的没有关系，不用交这个十万美金。
移民局官网在 H1B FAQ 里写的确是

• Requires a $100,000 payment to accompany any new H-1B visa petitions submitted after 12:01 a.m. eastern daylight time on Sept. 21, 2025. This includes the 2026 lottery, and any other H-1B petitions submitted after 12:01 a.m. eastern daylight time on Sept. 21, 2025.

那也就是说现在没有中签的所有人都要交这十万美金？那岂不是直接一个大断档？以后谁还来留学啊？
还是我理解错了？有没有小伙伴来打补丁！

还有一个附加免交十万美刀的条款：

Petitions Exempt from the $100,000 Fee:

1.The fee does not apply to: Beneficiaries with valid H-1B visas issued before September 21, 2025;
2.Petitions filed before September 21, 2025;
3.Petitions requesting amendments, extensions, change of status, or change of employer submitted on or after September 21, 2025, provided USCIS grants the request;
4.Beneficiaries who depart the U.S. to apply for a visa based on approved H-1B amendment/extension/change of status or change of employer petitions and/or seek to re-enter on a valid H-1B visa;
5.Beneficiaries who are abroad and have a valid visa stamp; and
6.Beneficiaries eligible for national interest exemption*.

第四条中，有 change of status，也就是从学生的 F-1 签证 → OPT → H1B 的身份转变不需要交这个费。

【这个条款的目的是为了屏蔽掉那些咖喱佬的外包公司批量生成 H1B 的那些人的。要么留学来，要么真优秀。】
