【NIW Appeal 后进入 Remand 阶段】求助相关经验，跪谢

之前在 NIW 被 declined 的时候有发过帖子：

今天收到了律所的回复，告诉我我的 case 被 remand to open 了，大概进入了 reconsider 的状态。律所说，这个回复相当的中立：

In this decision, the AAO withdrew the USCIS denial and remanded your NIW petition back to USCIS for the issuance of a new decision. This is encouraging news, as it indicates that the AAO found substantive issues with the original denial. However, please note that a remand does not guarantee approval; USCIS will review the case again and issue a new decision.

The AAO’s reasoning is significantly more competent and reasonable than the prior USCIS officer’s analysis. A few things to note: They specifically noted that the officer failed to address the exceptional ability claim altogether and neglected to provide any meaningful analysis. The AAO also outlined several factors that the officer should properly consider when reevaluating the petition and evidence. This is not necessarily a good thing for us, as they mentioned that "the record, as currently constituted, does not sufficiently establish the Petitioner's eligibility as an individual of exceptional ability".

With respect to the national importance requirement under the first prong, the AAO agreed with our argument that the officer conflated your proposed employment with your proposed endeavor, incorrectly characterized your field as "business industry," and failed to evaluate the endeavor in the proper context of artificial intelligence (AI).

Overall, the AAO’s decision is fairly neutral. It focuses on identifying the deficiencies and errors in the original adjudication but does not express a view on whether the evidence submitted ultimately satisfies the NIW requirements. As such, it is difficult to predict the outcome once the case is reviewed again by USCIS. Possible next steps may include: receiving an additional RFE or NOID, an approval, or a new denial without another opportunity to submit further evidence (though very unlikely).

Regardless of the final outcome, we believe this is a positive development. The AAO clearly recognized the significant flaws in the prior officer’s decision and acknowledged the strength of our arguments in the appeal and gave us another chance of getting the case adjudicated fairly and correctly.

又到了听天由命的阶段了，交给 USCIS 重审，谁又知道会审核多久，最终结果如何呢？

还是想来请问下地里有相关经验的前辈们：

1. Remand to open 之后还要走多久呢？我看地里的 timeline 有的人两个月后得到了回复，但是 USCIS 现在积压应该也很严重，感觉又是无比漫长的马拉松；何况我第一次提交还用了 PP，让这个流程更加繁琐了。
2. 我看了看 AI 的分析，说我新的申请几乎 100% 拿到 RFE，感觉还是挺麻烦的。一方面是我这一年来无论是引用、发表的文章、获得的推荐信和影响力都在快速上升（AI 领域的 scaling law）；此外，我已经从我们学校 on-leave 了 PhD，同时在申请 O1 和 NIW Refile。感觉中这个 case 如果还让我 RFE 一次，我的 proposed endeavor 肯定是有些变化的，之前写的是要当 TTAP（CS faculty），现在写的是要当 Research Scientist 了，感觉会很麻烦。

 任何之前 Appeal 的经验都想来请教下，我也试图在地里搜索过，可能搜索引擎太难用了吧，搜不到有用信息。感谢 🙏

当时看到这句话真是热泪盈眶，如果人人都选择所谓最理性选择，而没有人敢于直面不公，那裁决氛围只会随着人性之恶无底线恶化，
我没经验，只能给一句，加油！

只是同意再给你重审一次的机会，多数情况会换一个人审你的case，并不是说你必须通过。还是有三种可能，通过，RFE和deny。

很多人不选择appeal是因为这个折腾时间长，无非就是给一次机会省了再交申请费。

就是慢慢等吧，如果你之前PP过估计PP还是有效的。

加油，希望楼主能被approve，分享appeal的经验😂。现在移民局简直就是胡搞瞎搞随机过。

我看了看aao 能做出这决定基本上代表愿意再给你个机会，当然最差的情况是你被拖很久的时间到最后仍然deny. 若是不介意多花几千块，倒是可以找更内行的去包装你的case，等于花钱买个保险，降低内耗

如果楼主付了PP,那应该还是可以很快收到回复的。若是再有RFE建议楼主同时找第三方律师研究 我最近在红笛看到watkinsimmigration 是前USCIS officer离职出来执业，提供RFE和NOID review，或许楼主可以考虑类似的服务

感谢，重给机会的概率太小了

这个机会已经很好了，我之前niw被拒，引用400多，appeal之后没有remand，直接dismiss，加油祝早日approve
