H1B大概率没中 没有收到rejection 但是ead 过期还是可以继续工作？？！

蹭帖请教各位，我收到了类似公司I-9 re-verification的东西，没抽到工签. 我是九月过期， 请问七月到九月之间还能工作么？谢谢！

这边老板有保证明年调你回来吗

补充一下，在拿到rejection notice之后，第二天加拿大office发来新的offer letter，开始工作日期是当天，然后搬家这段时间算vacation。

我们公司“组”的概念比较模糊？去加拿大之后我还是在同个项目，manager也还是同一个人，内部组织没有变化，只是换了工作地点。口头上是说会调回来，当然没有书面保证。

你好，是可以的，opt过期时间和收到rejection notice日期，which comes later。

找了一下uscis的cap-gap网页的具体语句
"Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student's H-1B petition is selected and approved, the student's extension of status will continue through September 30. If the student's H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States."

60天grace period从date of rejection notice和opt program end date的later one开始算起，所以在那之前应该是可以工作的，所以像楼主的情况，应该是可以等到rejection notice再停止工作的

Please note: F-1 students who have entered the 60-day grace period are not authorized to work. If an H‑1B cap-subject petition is filed for a student who has entered the 60-day grace period, the student will receive the automatic extension of his or her F-1 status, but will not be authorized to work since the student was not authorized to work at the time H-1B petition was filed.
