加州Real ID与DMV Officer的对话

我是H1B holder，之前的REAL ID过期了，去DMV跟新，被告知由于H1B的VISA过期，只能给办普通驾照，所以问了一下DMV的officer。希望以下信息能帮到大家。

“After reviewing your documents, the only driver license (DL) DMV can issue you at this time is an AB60 type DL.  An AB60 DL entitles you to same driving privileges as a REAL ID DL.  Once you receive a renewed visa you may switch back to a REAL ID.  To apply for a REAL ID DL, you must present a valid/unexpired foreign passport, visa, and I-94.  Unfortunately, the DMV does not have the authority to accept your I-797A as an extension of your visa.  Please let me know if you have any additional questions or if  you would like to discuss this over the phone.”

“Thanks **** for looking into this.
I totally understand this is the policy of the federal government and not from the DMV.
But my concern is, as one of the tens of thousands H1B VISA holders, we do not always have a valid VISA and especially in this pandemic.
In order to get a valid VISA, we need to leave the United States and get a VISA application at one of the foreign embassies.
I guess if you can forward my message to someone who can evaluate this situation and policy, that would be great.
But if not, I appreciate your help and efforts.

“I agree with you that the REAL ID guidelines make it difficult for H1B Visa holders to maintain a REAL ID.  However, there is a REAL ID Modernization Act (2021) underway now and new REAL ID federal regulations will be established sometime this year.  Let‘s hope the new regulations help remedy this situation.”

San Mateo可以办real id 不需要visa stamp，i-797A即可

发现了？我被迫把外州的real换成了ca的unreal

这实在是没道理了。我目前opt中visa早几年就过期了给了ead就办出来了。真的太奇葩了h1b凭什么非要visa

意思是有H1B status或者 H1B extension status也不可以么，一定要回国签证才可以办Real ID？

请问楼主 renew 驾照直接网上就行了吗？

就是光有H1B的797没用，现在的要求是必须有H1B的VISA才行，而且的是有效期内。确实没啥道理

不客气，据我所知不行，H1B还是得去DMV Office renew。如果过了一个月都没寄到，建议打电话给DMV再查询下。

是的，确实没啥道理。我之前也是EAD给办的Real ID，没想到H1B还有这种奇葩要求。不过好在现在Real ID也没啥大用。

补充一个数据点，我两周前也是驾照过期，real id不符合条件。之前记得网上看renew普通驾照都不符合，这次又在dmv网站上看了下，竟然能renew了。我h1b还有一年多到期，这次online renew直接给了5年。。基本就是之前的expire year + 5 然后直接打印出来寄给我了，手续费38刀，一周竟然就寄到了。。。
补充：网站上只填了驾照号和个人基本信息，完全没有上传其它任何关于身份的资料。不知道是不是疫情为了方便大家简化流程了？

这个真的完全看DMV, 湾区的话可以去San Mateo的dmv试试。我是19年opt转h1b之后就没回国过，根本没有visa, 带上I797A和其他证明文件，10分钟walk-in办完REAL ID REAL ID REAL ID 工作人员没问任何东西，非常熟练
