I didn't know people would be upset by reading English in a post discussing "Asian Hate" when they presumably live in the US.  Nonetheless, I feel the need to elaborate because what judaszeng said is dangerous and erroneous legal advice.  I will continue to write in English as this discussion concerns US law.

Whether the perpetrator can be prosecuted with a hate crime does not depend on the extent to which OP suffers, but the evidence shown in this circumstance.  It would appear that the DA charged the perp with assault/harassment but not hate crime because they couldn't find demonstratable evidence of racial motivation.  Whether OP suffers from the most severe psychiatric illness imaginable has nothing to do with whether this can be prosecuted as a hate crime.  To suggest that OP should get more injured so that the assault can be bumped to a hate crime is just nonsense.
judaszeng also mentioned that "有了这些医疗记录,凶手就已经构成personal injury,是felony,DA是一定要进行公诉的".  
^This sentence is wrong on so many levels.
1) Personal injury is a subject of tort in civil litigation, not criminal.  
2) An assault resulting in injuries is not necessarily a felony charge.
3) Whether a case is a felony has nothing to do with whether the DA should/must prosecute.

从法律角度来说你说的没错。
不过受重伤和擦破个皮收到的舆论关注度完全不一样啊。

楼主整个过程干的好,虽然结果不尽人意。我对象也是在西雅图市中心的一个停车场遇到黑人女性猛敲她车窗,破口大骂,当时她紧张坏了,而我在plaza里面那个东西未在场。如果我在,恐怕我也要进局里了,因为我特冲动,有可能会动手。感觉楼主处理的很理智也很专业。

不过想补充一句,hate crime的设立,根本就不是为了保护asian。

hate crime如果有证据支持是可以去prosecute的,但是和其他刑事起诉一样都必须要有非常strong的evidence prosecutor才可以去用这个罪名起诉,不然case在法官那里也不会通过。大部分criminal case证据都没有非常足,所以大多数都会有plea deal罪名轻一等或者直接dismiss掉。
