The American Immigration Lawyers Association was recently contacted by USCIS with the following update:

As of February 17, 2022, USCIS-HQ (SCOPS) directed the Nebraska Service Center (“NSC”) and Texas Service Center (“TSC”) to cease adjudication of all EB Form I-485 cases other than those based on 4th preference petitions (religious workers, special immigrant juveniles, etc.). USCIS is reallocating all other EB-based Form I-485 Officers and resources to Form I-140 adjudications and backlog elimination. Meanwhile, the National Benefits Center (NBC) will add EB Forms I-485 to their existing EB workload, prioritizing applications for which immigrant visas are immediately available. A transfer notice will be issued to the Form I-485 applicant (and attorney of record, if applicable) once the application is sent to NBC for continued adjudication.

EB Form I-485 cases already with officers will continue to be adjudicated at the NSC and TSC, as will Requests for Evidence (RFEs) that have already been issued. Centers may relocate such cases to FOD when responses or other pre-processing is completed. I-485s that are concurrently filed with Form I-140 will also be relocated upon approval of the Form I-140 when a visa is available

NSC management has not provided a timeframe for how quickly individual cases will be transferred to NBC, but they informally indicated that approximately a thousand cases per week are already being shipped and that the number is expected to rise sharply. This is described as a long-term jurisdictional change directed by USCIS-HQ, and NSC, TSC and NBC are all in the process of implementing it.

Service Centers have a standing shipment schedule to send visa available EB I-485s with approved I-140s for which biometrics have been collected and security checks have been initiated to FOD for final adjudication for FY-2022. EB cases transferred to the NBC will generally be relocated to field offices for final adjudication, which may include an interview if deemed necessary. There are some cases that may be final adjudicated at the NBC if the case has already been deemed interview waived and previously reviewed for eligibility.



USCIS’ top priority are EB -I-485 adjudications and as result, USCIS expects to utilize a significant number of the available FY22 visas. (注意不是all)

FY2021财年，也就是在10/1/2020-09/30/2021提交的485，在SRC，总共5万份申请，目前只有3256份（6.2%）transferred to new office。
申请被批或者拿到卡的占2.2%，总共1150人。当然LIN的情况好一点。总体来说，还是要看他们transfer的速度。如果一天可以有300份transfer，那就是160个工作日。不过要知道还有32%的人指纹都没打好。所以再过8个月把FY2021的SRC 485都转出去应该是最好的情况了吧。

刚注意，这个消息是 as of Feb. 17, 2022。所以搞了半天已经实施了一个多月了。那SRC 最近的transfer 的速度也没有太大变化呀。

沒人知道會不會比較快啊。USCIS就是一個black box，從沒公開跟大家說過他們到底是按照怎樣的順序與流程批的。很多事情大家也只是根據過去幾年或幾個月的經驗去猜個大概的，也沒人能證實到底是怎樣。到現在也沒人能解釋為啥同樣是eb2、同樣是NSC，有人21年12月交485已經爆綠了，很多早半年甚至一年交的人卻還連combo卡在哪裡都不知道。說"have a standing shipment schedule"，但也沒公開跟大家說到底schedule長怎樣。到底有沒有schedule，還是只是說給議員聽的，no one knows。大家會對USCIS不滿不就是因為這樣子的不透明來的嗎。

這可以解釋為啥3月中的時候每天LIN都transfer幾千個case出去

现在LIN号码被批准的基本都是先Transfer到NBC的。所以没被Transfer的可能不会直接被批准。

我就是LIN concurrently filed，140 approve了，指纹也打了，这是说一定会transfer到FOD for final adjudication吗？这是不是说有望加快啊？

不一定，trackitt还是有不少LIN最近直接批的例子
