租房的application fee 是拿不回来了？

前几天看到一个小区的房子还不错，applied ，然后apply的时候交了$750 . application被批准了。可是三天过后我不想租那个房子了。

问leasing office，说是application fee不退还。因为在叫application fee的时候说了，如果申请批准，application fee是不退还的（当时交application fee的时候没仔细看）

是不是可以告leasing office？我觉得这个规定不合理。或者是不是直接电话信用卡公司或者debit卡的银行让银行把钱直接退回来？


“I hereby deposit $750 as earnest money, which will be considered a portion of my first month’s rent if my application is approved. If my application is not approved, the prepaid first month’s rent shall be refunded to me within seven (7) business days from the date of rejection. Upon acceptance of this application, I hereby agree to execute the Owner/Managing Agent’s standard form lease within three (3) calendar days of the date of approval. I acknowledge and agree that if my application is accepted and I fail to execute a lease for the apartment within said three (3) calendar day period, or otherwise terminate my application after the expiration of two (2) calendar days after the date of my application, I hereby agree that the Owner/Managing Agent shall be entitled to keep my prepaid first month’s rent in the sum of $750 as liquidated damages in payment for the Owner/Managing Agent’s time and effort in processing my inquiry and application, including making necessary investigation into the rental selection criteria and the time that the unit was reserved for me. I agree that this is a reasonable estimate of the Owner/Managing Agent’s damages as a result of my failure to fulfil my contractual obligation and is not to be construed as a penalty.”

earnest money就是为了防止你这种行为，approve以后改变主意的
犹豫你就别申请
通过了就是打算租给你了，你跑了别人不仅要重新走流程，还可能因为临近月底找不到更合适的租客了
如果租不出去你承担损失吗
合同就是合同，这条款没啥不合理，当然你愿意去打官司就试试看哪个律师给你打

这玩意叫deposit，哪有这么贵的application fee，吓我一跳

application fee是文件处理和做调查的费用，一般25~200不等，你这个不是application fee是deposit...而且签合同的时候上面不是写得清清楚楚如果你毁约改变主意了这个钱拿不回来了吗，如果觉得不合理当初就不应该签，合不合理不是你说的算的

公司有legal service吗？找租房律师问问？

这钱是leasing agent的commission，退不了

看字面意思是要不回来，至于条款合不合法应该是属于法律专业范畴了，可以雇个律师帮你评估一下

一般application fee也就200-300

但750 美元也太高了吧。感觉不退不合理啊。至少应该退一部分吧。并且我四天内就跟他说我不想租了

查一查你们州的相关法律，看看是不是合法的
