向AAO Appeal成功后，如何获得140？

请教一下从AAO decision 到 Form i-140之间要做什么吗？


我手上有一个NIW Appeal成功。 3月份， AAO来信说case已经发回去给TSC， the appeal is sustained. 但我现在没有收到approved 140.

另外，我有个Eb1的485在审，现需要把NIW Appeal成功的PD转到Pending485上。


问了Emma，没有得到任何有效信息。 收到回复如下：
Regarding the status of your Form I-290B, Notice of Appeal or Motion:
Our system shows that your Form I-290B, Notice of Appeal or Motion, was approved on March 22, 2023. Other than its final decision, the AAO does not issue evidence of an approved benefit request (such as a Form I-797, Notice of Action). The AAO also does not notify the Department of State (DOS) that a benefit request has been approved. Instead, the office that made the underlying unfavorable decision is responsible for issuing any documents relating to the approved benefit request and notifying DOS, when applicable.
The decision has been forwarded to the Texas Service Center for review. Unfortunately, there is no timeline for this process. If you do not receive further notice concerning your case within 180 days, please contact the USCIS Contact Center at 1-800-375-5283 (TTY 800-767-1833) for additional information.

给个时间线:
Oct 12, 2022,  I-290B was received by AAO.
Mar 22, 2023,  Appeal Decision made by AAO. Case was returned back to TSC. AAO Letter in mail box in late March.
June 10, 2023, I-140 approval notice in mail box.


A total of 236 days from Appeal received by AAO to I-140 approval notice on hand.

从AAO给决定到case转回NSC估计得等几周。我的case当时打AAO来信里的电话去问，过了三周多才转回NSC。

看了一下，就是你帖子里的电话。Officer很热心给查了一下状态，发回NSC的时间比AAO来信时间晚了三周多

当时Appeal的时候，主要被拒了是气不过了。所以，同时上了Appeal和EB1.

EB1在2022年12月底批了，但是排期没到。赶着圣诞节的时候送了485.

485是居于EB1的，排期没到。NIW appeal成功拿到NIW的140后，我就有2021年的排期了。

想問一下樓主是幾時上了appeal? 我是23年1月交了appeal,還沒有結果.
(appeal的原因也是因為有點氣憤 再加上自己另一半也在申請NIW)

22年10月初上的Appeal，23年3月份收到AAO的信，到现在还没有批处理的140（Case Tracker一致都是Case was Denied.）

另外，appeal成功率很低的，不要因为appeal耽误新的申请。

AAO直接批准了你的I-140(NIW)吗？ 否则的话，我的理解是USCIS会再重新审理你的I-140，然后再做决定.  也就是说，你目前并没有approved的I-140(NIW).  这里有人问过:

同意, 我老婆的都過了, 不過她的PD 是今年的1月, 所以還是等我的appeal看看有沒有結果

你说得对。
TSC reopened the case and then sent an approval notice. That's 3 months after receiving the decision from AAO.
