H1B 转F1 等待期间身份问题

9月初laid off。 grace period 只能到11月初。 请问如果我 在十月 file H1B 转 F1，请问在等待F1期间是否可以合法待在美国 （ 因为11月初以后 H1B 就不再有效了）。 从11月初到F1 批准的等待期间 身份合法吗？ 还是需要再file一个H1B 转B2 去维持等待期间的身份？

Other important information:

You can’t leave the US when your COS is pending.

If you leave the US after your status change has been approved, you will need to visit a US Consulate or Embassy in your home country to obtain your actual F-1 visa to re-enter the US in your new status.


Must maintain your current visa status until a new status is approved. This may mean you need to fill a “bridge” application to extend your current status (if possible) while your F-1 is pending. If your current visa expires before your F-1 is approved, it could result in your F-1 being denied.

Must inform OIS of any request for evidence (RFE), approval, denial, and receipt notice number.

A change of status can take anywhere from 3 to 12 months, but it could take longer.

You should receive an I-797, A Notice of Action from USCIS within 10 days of your check or money order being cashed. If you do not receive this form, please contact OIS. The I-797 form is a general notice, not an Approval or Denial of your Change of Status; however, approvals and denials are also issued on I-797 forms.

Beginning any employment may jeopardize your application for a change of status.

Accruing 180 days of unlawful presence will result in a 3-year bar from the U.S. and over 180 days will result in a 10-year bar.

539表格 instruction 第四页top， 有这样一段话。 （如果没有这段话， F1 pending 本身就算一种合法身份。 但是因为有这段话， F1 pending 期间就必须有其他合法身份）这段话说在开学前30天必须要有其他合法身份， F1 pending 不算合法身份。 但是我的H1b 再有不到30天就expire 了， F1 pending 本身不算合法身份的情况下， 我必须要file H1b转B2， 去维持F1 pending 期间的合法身份。 （当然如果转B2被拒， 也不成立了， 但那个是我无法掌控的）。

至少现在根据我的情况，我必须file 两个 ， 这才是符合USCIS 规定的做法 （人为刀俎， 我为鱼肉， 我说了不算，人家说的算）。否则， 我在F1 pending期间就没有其他合法身份了， 我转F1 的申请会因为这个原因直接被拒。 (这不就是为难人嘛， 也可以在转B2 下面加一段话， 规定B2 pending期间也必须有其他合法的nonimmigrant 身份， 可以不停循环下去了。。。）

From i-539 instruction page 4:
NOTE: A change of status may be granted for a period up to 30 days before the report date or start date of the course of study listed on Form I-20. You must maintain your current, or other, nonimmigrant status up to 30 days before
the report date or start date of the course of study listed on Form I-20 or your requested change of status may not be granted.

美硕加6年工作， 这在欧洲，在加拿大，都早可以拿PR了。 只有在美国，这么多年下来，还连个身份都没有。成天为了签证担心

没有身份真的是太难受了。。。因为身份是个基础，很容易有身份的人不会觉得身份有多宝贵，可是没有的话， 真的很不方便，不知道下个月是不是失业要走人，

真的被美国梦害惨了。。。

肠子都悔青了， 当年真的不该来美国， 去德国，法国， 加拿大，哪个都比美国强。。。哪怕工资少点都没关系， 美国的身份之难拿，除非你是牛人，可以进高校做教授，不用担心身份。否则真的不要来美国。

有同样的问题，请问楼主知道答案了吗？

现在得到的信息看， 需要file 两个， 转B2 用来维持等待F1期间的合法身份。 我在填表539的时候，又遇到问题， 是两个一块file （H1b 转 B2， H1b 转F1）吗。 还是先file  H1b 转 B2， 拿到receipt number 后， 再file B2 转 F1.

？？？你file F1要等待，难道file B2就不要等待吗？都是等待有啥区别？
F1的问题是，file以后pending期间肯定可以合法呆在美国
但是关键是啥时候批准，批准太早，你还没开学，这段时间你的身份有问题，F1只能在开学前一个月入境。
