友友们救救，EB1大跃进，老公要拿绿卡了，我J1豁免还没拿到可以先交485吗

我老公是22年5月批的eb1，最新24年1月的已经到22年7月了，所以他估计在明年1月前就会拿到绿卡，我原本计划在他绿卡下来之前交485的，现在的情况就是我J1豁免没办完来不及在那之前弄完所以没法交了

对，绿卡下来之后再结婚的就要走F2A婚绿了。但只要你们结婚在主申拿卡之前，就无需走婚绿，而是按follow to join。
另外，通常结婚不满2年的可能会要

所以只要结婚是在他拿绿卡之前，不管我的485在他拿绿卡之前交还是之后排期都不会变吗，我不太理解这个follow to join，不管是绿卡下来之前还是之后交都是follow to join吗，时间会有差别吗

目前就是这个情况，他预计1月之前能拿到绿卡，最新排期动到那里了，可是我1月前J1豁免没办完理论上交不了485，所以我感觉自己不能follow  to join了，所以想问问还有没有什么办法

只要在主申485批准之前就结婚的，随时可以follow to join（即主申已绿之后配偶才交485，或配偶在境外时先交824把主申140调去NVC再走CP）。

Derivative Spouse

In general, the derivative spouse of a principal beneficiary may be accorded the same priority date and classification as the principal provided that:

The marriage between the principal and the derivative spouse existed at the time the principal either adjusted status or was admitted to the United States as a lawful permanent resident (LPR);[38]

The marriage continues to exist at the time of the derivative’s adjustment of status; and

The principal remains in LPR status at the time the derivative adjusts status.

你真正应该担心的是自己的485还没交或者还没批，485排期倒退，老公的pd不再current.

eb1排期本来就是从current倒退的。这种事谁知道呢？

lz已经结婚了，就算家属绿卡被批后也能follow to join。唯一要担心的，前面也有人提到了，就是主申人的排期不能倒退，如果到时候倒退了，你需要再等他的pd再次变current后才能交485。
