H1B RFE的理由是学校是私立大学？

RT，今天收到这个notice（见下文），看到这个理由也是很奇怪。本人是在一个正规私立大学（排名前50）读的CE专业，master毕业。材料中也包含了official的成绩单和毕业证。不知道有没有小伙伴经历过类似的RFE，求高人指点，如果准备材料应该怎么准备？ 感激不尽。

ADVANCED DEGREE CAP EXEMPTION
You filed the 1-129 petition for the beneficiary under the advanced degree cap exemption. In order for the beneficiary to qualify under the Master's Cap exemption, the following must both be met:

1) U.S. Master's Degree
In order to qualify as a master's degree so as to meet the cap exemption requirement, the degree must be one for which a bachelor's degree in any field is required in order to obtain the "masters" degree. This ensures that the "masters" degree is a degree that is at least one level higher than a bachelor's degree, which is the essential component of a "masters or higher" degree.

2) Qualifying Institution
For purposes of this chapter, other than subchapter IV and part C of subchapter I of chapter 34 of Tide 42, the term "institution of higher education" means an educational institution in any State that-- In addition to meeting the above standard, the claimed master's degree must be issued from a U.S. institution of higher education as defined in section 101(a) of the Higher Education Act of 1965. That section provides as follows:
(1) admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate;
(2) is legally authorized within such State to provide a program of education beyond secondary education;
(3) provides an educational program for which the institution awards a bachelor's degree or provides not less than a 2-year program that is acceptable for full credit toward such a degree;
(4) is a public or other nonprofit institution; and
(5) is accredited by a nationally recognized accrediting agency or association, or if not so accredited, is an institution that has been granted pre-accreditation status by such an agency or association that has been recognized by the Secretary for the granting of pre-accreditation status, and the Secretary has determined that there is satisfactory assurance that the institution will meet the accreditation standards of such an agency or association within a reasonable time.

You submitted the beneficiary's master's degree from *** university（这边担心对学校影响不好就马赛克一下）. Records suggest *** University is a private university. You have not submitted evidence establishing the beneficiary meets the eligibility of an advanced degree cap exemption as detailed above.

楼主可以去http://nces.ed.gov/collegenavigator/ 查一下学校的性质(type)

私立学校一定要先查一下再确定可不可以使用Master Cap. 以USC为例，Type: Private not-for-profit -- 这样就是可以使用master cap的

如果是private for profit那就不符合法条的要求，如果使用了master cap且侥幸被批准了，以后也是有被revoke的风险。相关的学校例子暂时能想到的有Academy of Art University.

学校性质这一点首先应该律师要帮你看一下确认，但万一有疏忽的话自己也要千万注意。

要求里面写的：(4) is a public or other nonprofit institution; and

uscis认为你的大学可能是for profit的学校，这样你就不能申请master cap了。如果不是for profit那就回复不是，是的话那就没办法了。

移民局经常会RFE一些有的没的，有时候已经提供了的材料他也会RFE再问你要一遍。你按照要求回复他们需要的材料即可。只要你的大学是 non for-profit 的大学就可以申请 master cap。

哈佛也是私立大学，这也要RFE？

我实在是太好奇LZ是什么学校的了

谢谢哈，联系了学校的registrar，说是只能提供degree verification。。。但是那个以前已经的材料中已经给过了，而且我觉得degree verification也不能证明啥。不知道这种证明是nonprofit 的statement应该找谁去拿

你们学校是不是non-profit的网上应该能查到
