我贴一个guideline,LZ可以参考一下，只要满足下面四个的任何一个就行了，但是一般律师都会写至少2-3个，（你问我为什么知道这么多因为我也被rfe了。。。还在等结果。。）

According to 8 C.F.R. § 212.2(h)(4)(iii)(A), to qualify as a “Specialty Occupation,” the position must meet one of the following criteria:
1.        A baccalaureate or higher degree or equivalent is normally the minimum requirement for entry into the particular position;
2.        The degree requirement is common to the industry in parallel positions among similar organizations or, in the alternative, an employer may show that its particular position is so complex or unique that it can be performed only by an individual with degree;
3.        The employer normally requires a degree or its equivalent for the position; or
4.        The nature of the specific duties is so specialized and complex that the knowledge required to perform the duties is usually associated with the attainment of a baccalaureate or higher degree.

不知道你原来的律师证明了哪几点。。。

我原来那个律师只证明了最难证明的第4点 还只是扔samples 没写大段文字论述 当然也怪我之前RFE完全没操心...被拒了以后天天在论坛读各种帖子。。。
