加大米！求问离开美国超过五个月，但是F1签证2021年才到期，需要重新申请F1吗？

我2018年12月的时候毕业，申请的是Fall19入学，大概率应该是7月或者8月入境开始新的program，走的时候去ISS问了一下，staff说只要我的Visa valid，之后拿着新的I20和之前的F1签证再入境就可以了。结果2月初离境回国的时候，走自主海关发现护照芯片坏了，工作人员建议回家后在当地重新办理新的护照，发朋友圈问护照上的有效签证怎么办的时候，有两个朋友提醒说，我离开美国的时间超过了五个月，之前的F1自动作废，需要申请新的F1签证，但是我走之前，ISS staff没给我说这件事啊所以是有离开美国超过五个月需要重新签证的规定吗？我还想问一下，这五个月是从我毕业的12月开始算还是从我离境的2月初开始算呀？请大家给懵逼宝宝解答一下，谢谢各位啦，会加米哒！！！！

打了电话问学校的ISS，SEVIS number是一毕业就终止了，需要申请新的I20，sevis number会改变；发邮件问了CBP，CBP回复不需要办理新的F1签证，我发去的邮件和CBP的回复如下，

I am an international student who has finished my first master degree already in the States in December, 2018 and then I left the US in early February without applying for OPT. My second master program will begin in August, 2019 and I want to ensure whether I am supposed to apply for a new F1 visa or not?

My current F1 visa is still valid and it will expire in year 2021 but I did not transfer my old SEVIS number to my new school since I have not decided which school to attend at that time. I have been told that my old SEVIS number has been terminated once I have graduated from my first school and I need to apply for a new I20 as well as a new SEVIS number. For this case, should I apply for a new F1 visa with my new SEVIS number or can I re-entry the US with my current F1 visa and my new I20?

Last question, the sensitive electronics contained in my current passport has been damaged and the Chinese CBP officer has suggested me re-applying for a new passport. If I apply for a new passport, the new passport number will be different from the passport number on my current F1 visa, will it have influence on my re-entry to the US later?

Thank you for contacting the U.S. Customs and Border Protection (CBP) Information Center.

You may travel to the U.S. with your same valid F-1 visa along with your new I-20. If you obtain a new passport, you may travel with both the older passport with the valid visa inside along with the new valid passport as long as they both display the same country of citizenship.

更新一个我问我们学校的five months policy的结果：
What you refer to as the “five month rule” exists to handle a very specific situation.  The five month rule allows us to request a reactivation of a closed immigration record of a student who takes a Leave of Absence from their academic program and is readmitted to return to that academic program on campus within five months of the last day they attended classes.  So if you last take classes in May, take a Leave of Absence for the Fall semester and return in January (7 months later), the five month rule is not applicable.  If you last attend classes in December, take a leave of absence for the Spring semester and return for the Fall semester in August (8 months later), the five month rule is not applicable.  It is usually something applied in situations where a student takes a Leave of Absence in Spring and returns for summer registration.  If immigration allows us to reactivate that record, the student would not have to pay the SEVIS fee again and the less than 5 month interruption of study is not counted against the student in terms of the one academic year requirement of full-time study required for CPT and OPT eligibility.

建议去uscis看看相关信息，那样比较准确

其实你2018年12月毕业后没申OPT也没把sevis i20转去新学校的话，一离开美国你的sevis record 就终结了，因为你算是完成学业离开美国了。所谓离开美国5个月的相关规定，值得是没毕业，中途需要离开美国5个月干点别的事情（休学或者美国境外做实习）。

你的SEVIS record是否已经终结，得问你原来的学校。如果终结，就需要重新交200刀拿新的sevis number然后重新申请F1签证。旧F1签证上面写的是旧的sevis number，不能用了

谢谢你啦，我的确毕业后没有申请OPT，然后当时学校结果还没全部出来，也没有把sevis I20转去新的学校我今天打电话好好问一下学校，谢谢你啦

赞同楼上的说法，lz要重签。
Lz没申OPT，也没能及时申请Spring 2019项目（可直接转sevis，新i-20的sevis号不变）。离境时，sevis record终结。
Sevis号若改变，就得重签。
