As you may know, Senator Lee (UT) introduced S.386, the Fairness for High-Skilled Immigrants Act, in an effort to facilitate a more equal access to immigration visas for foreign-born individuals. If enacted, the bill would increase the per-country cap on family-based immigrant visas as well as eliminate all country caps for employment-based immigrant visas. The bill would also establish transition rules for employment-based visas from FY2020 to FY2022, reserving a percentage of EB-2 and EB-3 visas for individuals who are not from the two countries with the largest number of recipients of those visas. For the unreserved employment-based visas, no more than eighty-five percent would be allotted to immigrants from any single country.
As a member of the Senate Judiciary Committee, with oversight of our immigration system, I believe Congress has a duty to protect our families and communities, and to uphold our immigration laws.
