川普已经签署的60天内限制移民的行政命令里有哪些例外？

华盛顿日报今天4月22日周三美西时间下午四点报道，川普已经签署在60天内限制移民的executive order行政命令。川普称他在周三晚的每日任务行动简报会议前已经签署了这项行政命令。

据华盛顿日报报道，这项行政命令旨在60天内暂停进入美国的移民（immigrants）。它也包括了几项例外（exceptions）。

Section 1. Suspension and Limitation on Entry. The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation.

有网友指出，移民不包括H1B，L1，F1等非移民签证。这些非移民签证不受该行政命令的影响。楼主同意该观点。



例外1：已经在美国生活和工作而申请绿卡的人不受影响。

(a) The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who: (i) are outside the United States on the effective date of this proclamation;

楼主认为已经在美国工作并在申请绿卡的小伙伴不受影响。


例外2：美国公民的配偶和孩子不受影响。但是其他希望移民的亲属受影响。

(b) The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to: ... (iv) any alien who is the spouse of a United States citizen; (v) any alien who is under 21 years old and is the child of a United States citizen, or who is a prospective adoptee seeking to enter the United States pursuant to the IR-4 or IH-4 visa classifications;


例外3：用于暂时工作的非移民签证不受影响。
楼主认为H1B不受影响，因为H1B是暂时的不是永久的。


例外4：医疗和其他抗击病毒的必要工作者不受影响。

(b) The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to: ... (ii) any alien seeking to enter the United States on an immigrant visa as a physician, nurse, or other healthcare professional; to perform medical research or other research intended to combat the spread of COVID-19; or to perform work essential to combating, recovering from, or otherwise alleviating the effects of the COVID-19 outbreak, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees; and any spouse and unmarried children under 21 years old of any such alien who are accompanying or following to join the alien;


例外5：EB5投资移民不受影响。

(b) The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to: ... (iii) any alien applying for a visa to enter the United States pursuant to the EB-5 Immigrant Investor Program;

不知道对现在在国内H1B under AP的有没有影响

现在还能在国内办h1b免面谈代传递吗？

例外二错了。公民配偶是不影响，但原文并没有提绿卡持有者配偶什么事。

注意Section1是整个EO的大前提，这里限制的是aliens as immigrants。
这个行政命令只是限制境外的immigrants，即人在美国境外申请美国绿卡或移民签证。
对于nonimmigrants，不管是F1 H1B L1 J1，不管是境内境外，均不受影响。
