h1b layoff期间只要寄出transfer就可以合法工作的uscis文件

昨天楼主遇到了奇葩的事情 楼主新公司的internal legel team 没搞清楚h1b transfer的条款 说必须在grace period里面receive receipt才可以工作 险些撤销了楼主的offer
楼主男票机智的在uscis 错综复杂的legal document里面找到了只要寄出就可以合法工作的document
楼主想分享给最近被layoff的伙伴们 in case 哪个公司的hr或者legal team再搞错
这只是没学过法律的我和我男票找到的一些有用的证据 每个人的case可能会有所不同 但是可以江湖救急
毕竟如果遇到要撤销offer 我们再临时请律师应该是来不及的
因为找这个也比较辛苦 希望大家如果觉得有用可以给一些大米！

1. As long as the new employer files the H-1B transfer you can start to work

Section 214(n)   of the INA provides that a nonimmigrant who was previously issued an H 1B visa or provided H 1B nonimmigrant status may begin working for a new H 1B employer as soon as that new employer files a nonfrivolous H 1B petition on the nonimmigrant's behalf.
The condition also states that
      ·           The nonimmigrant was lawfully admitted to the United States;      
      ·           The nonfrivolous petition for new employment was filed before the end of their period of authorized stay; and      
      ·           The nonimmigrant has not been employed without authorization since his or her lawful admission to the United States, and before the filing of the nonfrivolous petition.

2. Within 60 days, we are lawfully present.

"An alien admitted or otherwise provided status in E-1, E-2, E-3, H-1B, H-1B1, L-1, O-1 or TN classification and his or her dependents shall not be considered to have failed to maintain nonimmigrant status solely on the basis of a cessation of the employment on which the alien's classification was based, for up to 60 consecutive days or until the end of the authorized validity period, whichever is shorter, once during each authorized validity period."

3. Since I've established my lawful status during the grace period of 60 days, I don't need to maintain my nonimmigrant status as long as I properly file an adjustment application with USCIS.

Properly Filed Adjustment Application,

For purposes of the bars to adjustment, a nonimmigrant only needs to maintain his or her nonimmigrant status until the time he or she properly files an adjustment application with USCIS so long as the nonimmigrant does not engage in any unauthorized employment after filing the adjustment application. An applicant does not violate the terms of his or her nonimmigrant status merely by filing an application to adjust status as long as the application was properly filed when the applicant was in lawful nonimmigrant status.

額 我覺得樓主新公司的法律人員說得沒錯誒... 因為properly filed是按uscis接收案件日期看的，就算寄出是grace period裡面，如果receipt date不是的話那也算過期的。不知道樓主具體情況怎樣，也有可能有很長一段時間才到60天grace period用完，但是樓主公司legal team的說法是對的。而且一般謹慎起見都會建議拿到receipt再開始工作，確保不會有unlawful employment的狀況出現。

然後樓主引用的第三條，adjustment of status是指申請綠卡的情況喲，其他轉僱主啊轉簽證類型之類的都是change of status。所以這條是不適用於樓主的情況的。這條說的是綠卡申請人在入境到遞交申請之前身份狀態都要保持合法這樣。

我的律师的说法是说USCIS收到就可以开始工作了，可以用ups/usps的delivery confirmation作为证明，而不需要等到uscis回寄receipt（毕竟回寄receipt也需要两周呢……）所以我觉得楼主男票没说错，只是发帖的时候可能没写太细

我的意思就是這樣的 是要USCIS收到 申請人寄出並不一定為準 而且等receipt也不是為了說受到uscis回寄的回執那天 而是可以看到上面receipt date這樣確保不會出問題 而且有時候有些件週末寄到了 但是service center並不會process 這樣子receipt date他們有可能會順寫到下個週一 如果剛好卡在grace period後一兩天 那樣就很危險了

楼主你好。我想问一下如果今年4月份刚抽中H1B,但上周被lay了。这个H1b还有可能保住吗？和公司HR确认过了还没寄出去。谢谢了！

我也是同样的情况，我公司说这个保不住了因为有compliance issue. 寄出去也要被revoke的

赞一个楼主男朋友 哈哈哈哈 在走同样的流程 问了很多律师 包括现在在办transfer的公司律师也是说只要在grace period寄出了transfer材料 哪怕没有收到receipt也没有关系 身份是可以合理留在美国的 收到receipt之后就可以开始工作了
