Duke的Visa部门回复：关于限制F/J签证入境的proclamation

坐标北卡杜克，现在ECE博二，在7校中一所读了6年书。周五白宫发了proclamation后我就给学校Visa Services发了邮件，赶上了一个周末所以今天才收到回复，贴下面：

Dear XXX:

We have posted this information on our website.

Please call me at xxx-xxx-xxxx if you believe you meet the stipulations in the proclamation so we can individually discuss your concerns.
•        "The Secretary of State shall consider, in the Secretary’s discretion, whether nationals of the PRC currently in the United States pursuant to F or J visas and who otherwise meet the criteria described in section 1 of this proclamation should have their visas revoked pursuant to section 221(i) of the INA, 8 U.S.C. 1201(i)."
Note that a “visa revocation” means that the visa in your passport is no longer valid. Your I-20 controls your stay in the U.S., not the visa in your passport. If your visa was still current on face value and you leave the U.S., you must go to the U.S. consulate to request a new visa for reentry.

At the interview, if you meet the requirements stated in the proclamation, you will be denied a new visa.
•        "Within 60 days of the effective date of this proclamation, the Secretary of State and the Secretary of Homeland Security, in consultation with the heads of appropriate agencies, shall review nonimmigrant and immigrant programs and shall recommend to the President, through the Assistant to the President for National Security Affairs, any other measures requiring Presidential action that would mitigate the risk posed by the PRC’s acquisition of sensitive United States technologies and intellectual property."
Our current response is there is no indication that a student will be deported. Only an immigration judge can deport you and this was not mentioned in the proclamation. We must wait to see if there any further instructions or restrictions from DHS on this issue during the next 60 days.

查了一下回复的人是部门Director，靠谱，看了之后舒服了一些。首先我的签证早已过期，本来也没准备毕业之前出美国，现在手上也没有有效的美签，所以也不怕什么revocation。之前担心的只是被驱逐的问题，和美国朋友聊了聊，真要驱逐一个人总要有个理由，如果说危害了美国的国家安全那么请拿出证据，谁主张谁举证，这样扯皮下去估计无解。

现在在境外的小伙伴们可能真的会受到影响，早日申请一些欧洲、澳新的学校吧。还在美国的兄弟姐们们，做守法的foreigner，不要给自己惹上麻烦。

感谢这几天Warald和地里众大佬的一通分析和宽慰，踏踏实实回去干活了。

是的你没看错，你说的那些我都不准备去做了，就在美国呆着，就是坐牢。为的是未来几十年的旅行自由，所以牺牲十年我接受。

厉害了。我感觉我可能做不到，不说旅行了，连家人亲友都见不到真人。就算熬了十多年拿到了绿卡，也三十多岁了，心态也变了。二十岁的时候，我的黄金时代，为了一张卡片要放弃那么那么多，感觉做不到……

不过楼主能接受接下来四到五年无法回去看家人吗…

感觉deport可能性不大
现在担心的是被revoke visa后，接下来的opt和h1b办不成

感谢楼主，这个信息很有用，暂时不需要担心过多、好好学习就是了，暂时不要回国了，早日毕业早日拿到学位，再做打算。

那确实是没什么后顾之忧了

目前来看风险主要是两方面：
1）如果离开美国，重新签证或者入境时会被拒。
2）在美国境内申请OPT或者转身份 COS 时会遇到麻烦，即使批准也很可能需要被迫在境外激活（CP），结果同1

国土安全部目前还没有公布具体的对境内F1/OPT的措施，应该还在计划中，猜测如果有 也可能就是移民局直接通知个人身 份过期，要求立刻离境，不会是直接deport
