[租房] 房东擅自进入房间被拍到,想去告,求建议和帮助🙏

事情大概是我和我女友在入住10天后(7.29)与房东因为扔垃圾问题产生口角(我们已经把垃圾扔到垃圾桶内,但是房东以她垃圾太多为由拿出来并且叫我们去外面扔),然后我个人因为直觉在当天出门时把笔记本摄像头录影打开,回来过后发现房东擅自进入我们房间并且到处拍照以及翻看我们的东西。当时发现后立马打911以及跑去警局,但警察并没有很在意只是随随便便写了下笔录就草草了事。然后第二天(7.30)我们又拍到房东擅闯我们房间做类似的事情,并且在当天告诉她我们知道这件事,但是尝试和解要求她提前停止租约以及退退还已经预付的6个月房租。她当时最终是同意了并且手写了一份收到钱后互不追究的免责书,并且我和她还签了字。但房东以她要去复印为由直接拿走所以我们现在也没有证据.... 然后今天早上房东通知说加州法律规定租客提前解约需要付完剩下的钱或者找到人转租,并且以此为由拒绝退还租金,所以我们现在打算去法院告她。 我们的合约上是有说进入需要提前24小时通知并且这种行为在加州应该是违法的,但是我们对于告的流程完全不熟悉,希望地里的大神们可以提供建议和帮助,感激不尽🙏🙏🙏🙏

10. LANDLORD'S RIGHT OF ENTRY: LANDLORD may enter and inspect the premises during
normal business hours and upon reasonable advance notice of at least 24 hours to TENANT.
LANDLORD is permitted to make all alterations, repairs and maintenance that in LANDLORD'S
judgment is necessary to perform. In addition LANDLORD has all right to enter pursuant to Civil Code
Section 1954. If the work performed requires that TENANT temporarily vacate the unit, then TENANT
shall vacate for this temporary period upon being served a 7 days notice by LANDLORD. TENANT
agrees that in such event that TENANT will be solely compensated by a corresponding reduction in
rent for those many days that TENANT was temporarily displaced.

If the work to be performed requires the cooperation of TENANT to perform certain tasks, then those
tasks shall be performed upon serving 24 hours written notice by LANDLORD. (EXAMPLE -removing
food items from cabinets so that the unit may be sprayed for pests)
我个人查到的Civil Code Section 1954的内容
1954. A landlord may enter the dwelling unit only in the following
cases:
(a) In case of emergency.
(b) To make necessary or agreed repairs, decorations, alterations
or improvements, supply necessary or agreed services, or exhibit the
dwelling unit to prospective or actual purchasers, mortgagees,
tenants, workmen or contractors or to make an inspection pursuant to
subdivision (f) of Section 1950.5.
(c) When the tenant has abandoned or surrendered the premises.
(d) Pursuant to court order.
Except in cases of emergency or when the tenant has abandoned or
surrendered the premises, entry may not be made during other than
normal business hours unless the tenant consents at the time of
entry.
The landlord shall not abuse the right of access or use it to
harass the tenant. Except in cases of emergency or when the tenant
has abandoned or surrendered the premises, the landlord shall give
the tenant reasonable notice in writing of his or her intent to enter
and enter only during normal business hours. The notice may be
personally delivered to the tenant, left with someone of a suitable
age and discretion at the premises, or, left on, near, or under the
usual entry door of the premises in a manner in which a reasonable
person would discover the notice. Twenty-four hours shall be
presumed to be reasonable notice in absence of evidence to the
contrary. The notice may be mailed to the tenant. Mailing of the
notice at least six days prior to an intended entry is presumed
reasonable notice in the absence of evidence to the contrary.
If the purpose of the entry is to exhibit the dwelling unit to
prospective or actual purchasers, the notice may be given orally, in
person or by telephone, if the landlord or his or her agent has
notified the tenant in writing within 120 days of the oral notice
that the property is for sale and that the landlord or agent may
contact the tenant orally for the purpose described above.
Twenty-four hours is presumed reasonable notice in the absence of
evidence to the contrary. At the time of entry, the landlord or
agent shall leave written evidence of the entry inside the unit.

🙏🙏🙏首先很感谢大家的帮助和意见,你们真的让我感到很温暖。然后我想补充一下关于房东的一些信息,房东是一名中老年女性(所以楼里那位应该不大可能是)根据她的口述,她的前夫在10年前在加州自己偷偷办了离婚并且把几乎所有财产都转到了小三名下,并且还疑似收买了她的律师所以她输得很惨,以至于几乎没有钱并且只剩下一套和他前夫共同拥有的房子(我们现在住的)。除此之外她也应她前夫的要求把我们交的房租的50%转给了她前夫,再加上她之前说她用我们所有的押金找人去·修理清洁厕所了,所以她现在无法拿出钱来偿还。我想请问一下这种情况如果法院判我们赢,但她却无法偿还该怎么办呢?还有一点就是我之前在帮她砍树的时候听到她口述说她发现门口有一个摄像头,但不是她装的,她并不清楚是谁但怀疑是她前夫,然后询问我有没有什么解决方案。我今天告诉她应该报警,她却说她改变主意了,那个摄像头是“保护”她家的,所以她不愿意处理。请问各位这种情况算是对我们的隐私安全造成侵害吗?

关于和平解决,这是房东的态度:
Early Termination,
違反訂定優惠租約遷出者,
短租價以歷年出租史計算租金.
Early Termination,
租約期之空屋租金損失, 由租客承擔,直到該房有新租客補上.
歡迎履行合約,
老婦無須獨撐沉重財務壓力.

楼主你好像只是租了房东一个房间吧,这样你的权利很有限,打官司也很难赢,建议跟房东和好吧……

好吧,楼主需要找litigation lawyer,证明房东进你房间给你带来了多少金钱上的损失。small claims不管这些事的,警察显然也没管。

我也不看好楼主能要回任何已经交了的房租。

不需要请律师,小额法庭也不允许请律师。你有理有据是房东破坏租约,随时擅闯也造成了你的安全隐患,去法庭上说清楚就好。当然你可以提前付费咨询律师也可以请律师帮做材料什么的,应该费用可以加进要求房东补偿的钱款里面。

楼主你在加州吗?
如果你在加州就不用害怕了 100%会赢 拖欠房租 破坏房子 这些房东有理有据在加州都是租客赢😂😂😂
