想问一下 换成新规之后H1B是直接给还是抽签呢

还是得看申请H1B的人数啊，如果新规之下申请人数真的少于8.5万人（每年工签名额）就不用抽，如果符合要求的人数还是多于8.5万人，那还是要抽啊。只是人数变少概率变大。

新规定一点意义都没有，刚才律师证实，H1b可以按照part time申请。那么抽签人数一点变化都没有，可能有人part time两三份会有更多的抽签名额被占用，我说的对吗？

懒癌症想要尽一份力。。有没有好心人可以提供大方针模版。。

60天生效岂不是大选之后吗？会有什么影响？DHS的head到时候有可能已经换人了？

新总统是在明年一月正式履职....上任之后事情很多，就算换DHS的老大，也不知道猴年马月了

如果你是full time job按part time处理是违法的 你愿意这么提心吊胆的 万一被举报了 直接就犯法了吗？

感觉是大势所趋 今天告下来了 明年还可能再来一次 后面每年都有可能 有时候真挺无奈的 不欢迎你写在脸上 这次解决了 谁能说绿卡下来之前不会再这么几次 好窒息 万一一次没反抗成功 都没意义 不想这么寄人篱下受制于人提心吊胆的生活 我的青春赋予给珍惜我的祖国难道不香吗

刚刚写了关于DOL prevailing wage raise 的comment。 自己有几个想写的点，简而言之，工资定价不合理，超出地区行业的区间值；新要求没有合理的市场调查；发布于IFR,缺乏合理的审核过程；新规引用的数据存在不严谨，误导大众的问题； 我准备一条一条，每天写一下。。。 语言就是小学生英语，求勿喷。。。。也请大家给新的思路，头脑风暴。

Here I am writing to strongly DISAGREE with the change from this Department of Labor(DOL) new rules of prevailing wage increased effective as of 10/8/2020. The purpose to protect American workers are good faith but the new setup prevailing wage lines are ridiculous and beyond the market standard.
1. Firstly, DOL indicated some data in recent 3 years which try to demonstrate the current prevailing wage (Level 1-4) are far lower than "SHOULD BE". To against this misleading information, we need learn how this 4 levels setup for different stages of one position. Level 1 generally applies to the junior/staff position which requires basic skills as entry level and Level 2 generally applies to 2-5 year experiences Senior/Senior Associates position which require the people have higher level skills to deal with specific projects. As an ACCOUNTANT, based upon Dallas-Fort Worth area, the staff accountant salary is
a.$57,241 on average (Source from: https://www.indeed.com/career/st ... salaries/Dallas--TX),
b.$41K-63K Median 53K (Payscale: https://www.payscale.com/researc ... /82cd9471/Dallas-TX)
c. Under new prevailing wage system, Area Code 19100 Dallas-Fort Worth-Arlington, TX Level  Wage $35.25 Hour - $73,320 a year.

The requirement base on $73,320 is 16% more than the High Range $63K which per Payscale, only 10% Accountant in this area could achieve to annual salary $63K. This new prevailing wage system requires a foreign worker to be only Top 10% of this group, but also require almost 2-3% of the group. There is no way to be critical on foreigner/workers to be 1% of the group!

2. The Salary of a position is impacted by skills also market. The DOL's new system quoted from the wage/salary level from top H1B sponsors, "Ernst & Young U.S., LLP" provided 88.59% higher than prevailing wage on average from their "Table 1—Top 20 H-1B Employers by LCAs Filed: Average Rate at Which the Wage Offered Exceeds the Prevailing Wage"". Compare with new system Level 1 Prevailing wage list before $73,320, there are $14,607 lower as 19.9%. DOL wrongly picture data to the public and it is "FAKE NEWS"
