美国司法部起诉耶鲁大学歧视亚裔美国人和白人申请者

美国司法部起诉耶鲁大学，称其歧视亚裔美国人和白人申请者，偏袒黑人和拉丁裔申请者，"强化了基于种族的破坏性成见"。

司法部周四提交的申诉称，对于绝大多数申请者来说，亚裔美国人和白人的录取可能性只有同等资格的非洲裔美国人申请者的八分之一到四分之一。

司法部表示，这种涉嫌歧视的做法已经持续了至少50年。

耶鲁大学方面否认了这一指控。

The Department of Justice has sued Yale University for allegedly discriminating against Asian American and white applicants in favor of their black and Latino counterparts and “reinforcing damaging race-based stereotypes.”

The complaint filed Thursday by the Trump administration said that for the great majority of applicants, Asian Americans and whites have just one-eighth to one-fourth of the likelihood of admission as similarly qualified African American applicants.

The DOJ says the allegedly discriminatory practice has been going on for at least 50 years.

虽然亚裔作为大学录取中被逆向歧视的主体，在这事里更像是被司法部利用了来掩护白人，但不管怎么样这事总归是对亚裔的利好，就当是搭顺风车了吧。

原来告的时候是带着白人一起呢！四分之一不也是八分之一的两倍么。

很多人并不了解这事情的背景，这事情的幕后推手是犹太裔保守派活动家Edward Blum，有名的费舍尔案就是他的手笔，之前很多民权案件都有他的身影，2013年谢尔比县诉霍尔德案件中推翻1965年《投票权法案》一项核心条款。你们可以了解一下什么是杰利蝾螈和为什么低投票率有利于共和党就明白这人的政治动机。“In Shelby County, the Supreme Court struck down Section 4 of the Voting Rights Act of 1965, which subjected certain states and parts of states to federal scrutiny when they tried to modify voting procedures.[7] This scrutiny, known as "preclearance", was intended to prevent states from enacting voting procedures that disproportionately burden racial minorities. After unsuccessfully lobbying Congress to modify the preclearance rules in the Act's 2006 reauthorization, Blum set out to challenge the Act's constitutionality in court. He wanted to change or eliminate the law because it had led to the pro-minority gerrymandering which he encountered in the 1990s when he ran for Congress.[8][9] He eventually persuaded officials in Shelby County, Alabama to sue the federal government. The Supreme Court's ruling was a major victory for Blum.”
为了和哈弗打官司，2014年他建立了“学生公平录取组织”，这组织其实只有他一人，背后则是几大保守派组织提供资金来源，而且初期也没亚裔什么事，全是白人学生。
事情转机出现在15年，又一个佛州的华裔成立的“亚裔教育联盟”对哈弗提起诉讼，但司法部并未受理，但Blum看到了机会，于是两个组织走到了一起，这案件里第一次出现了亚裔的身影。
以上是这件事的背景。下面是我的看法：
我同意美国大学对亚裔录取的流程存在问题，但我不认为和这种人搅在一起能解决亚裔的问题。目前美国政治激化，司法部甚至最高法院也成为川普个人利益和保守派的政治议题而践踏亚裔尤其是华人利益（微信，tiktok， 以及未来可能的阿里和腾讯。。。），这事情最终结果可想而知，亚裔尤其是华裔并不见得能从这判决中捞到什么好处。很多事情并不是喊一声支持aa或者反对aa就能解决问题，把事情单纯一分为二看到则是忽视了其背后复杂的社会背景
当然我并不是什么法律政治专家，也无法对这个事情给出任何解决方案。以上只是作为一个旁观者以及社科爱好者的观察和判断而已
