你确定么？法案如果这届总统不签字，即使国会过了，也会自动报废？有相关的法律依据么？

Once a Congress adjourns, however, at the end of its two-year cycle, all bills that have been introduced in either the House or the Senate that have not made it through the entire legislative process and signed into law are dead. This includes bills that may have passed both the House and the Senate but were never finalized and sent to the President for his signature; bills that passed one house (either the House or the Senate) but not the other; bills that were the subject of committee or subcommittee hearings but were never considered by either house; and bills that never got more action after being introduced.

感觉讨论将来绿卡排期是一码事 是不是被针对是另一码事 反正律师都觉得Chinese被针对了 今天通过这个明后天怕不是又要通过什么别的幺蛾子 说定点打击不过分吧

跟事业没关系啊，NIW不需要雇主支持，可以申请完等到排期直接在国内调整身份。全家拿到绿卡老婆带着孩子出国上公立学校，教授继续待在国内，过了两年直接放弃绿卡。孩子继续在美国上学。

emmmmm 可是即使yd拿到的低于85%，80/75 甚至70%，那也已经很多了吧....中国人职场上被yd打压还是确实存在的...个人还是觉得从长远角度看，不容乐观...

Update Dec 2, 2020: HR 1044/S386 has passed Senate today without any objections after Mike Lee attempted a unanimous consent voting.

What next?

As they say, there are many slips between the cup and the lips, we still have a long way to go to see the light of the day without country-based discrimination.

House 1044 and Senate S386 have quite a number of differences. These need to be resolved.
Once the differences are reconciled, the new reconciled bill will need to be passed again in both House and Senate separately. This may again take months if not years.
The final step would be the President’s signature.

Timeline

Do not celebrate yet as the above can again take months and years before the law takes effect. The congressman still needs to talk to each other and reach a common ground.

There is no fixed timeline at this time.

现在两院版本还不一样 要看最后的条款到底是什么 如果三年的过渡期也被取消的话那哪怕是有了pd的中国人也要排比现在长的多的队了.真的不是好事

因为参众两院的版本有差异，接下来需要两院重新商量一个妥协的版本。然后新版本需要先过众议院，再过参议院，然后总统签字才能生效。

还有一段路要走。能不能再次两院都能过？目前的情况看，过是早晚的事情。看看大陆出生的能不能在新版本争取到更多利益吧。

现行的policy有两个affiliation——
1) 人与组织之间的关系，affiliation是指不是member，但是给组织提供实质支持
2) 组织之间的关系，INA定义的Communist Party包括了“Any section, subsidiary, branch, affiliate, or subdivision of any such association or party”
所以按照现行的policy，共青团员是因为member of affiliate of communist party被卡，不是affiliate of communist party

S386的文本里明确说是affiliate of C C P，所以不存在2)的扩展。当然共青团员理论上仍然被现行policy卡住。
