S386禁止党员和军人办绿卡引起恐慌，国防七子毕业的我来做个科普贴

第一部分，大家都很在意affiliate to 党员 and military force，我自己很在意后半部分。我根据我能找到的发文来解释，我对重要内容全部highlight

e. (U) Definition Of Affiliate:

(1)  (U) In General:  The term affiliate as used in INA 212(a)(3)(D) an organization related to, or identified with, a proscribed party or association, including any section, subsidiary, branch, or subdivision thereof, in such close association as to evidence to or furtherance of the purposes and objectives of such association or party, or to indicate a working alliance to bring the purposes and objectives of such association or party.

(2)  (U) Defining Affiliation:  INA 101(e)(2) states: “The giving, loaning or promises of support or of money or any other thing of value for any purpose to any organization shall be presumed to constitute affiliation therewith; but nothing in this paragraph shall be construed as an exclusive definition of affiliation.”

(3)  (U) Affiliation Requires Positive Action:  A mere intellectual interest in, sympathy for, or favoring the ideologies of the Communist or other totalitarian party does not constitute affiliation with such an organization unless accompanied by some positive and voluntary action that provides support, money, or another thing of value.

g. (U) Service In Armed Forces Of Communist Or Communist-Controlled Countries:  As stated in 22 CFR 40.34(b), service, whether voluntary or not in the armed forces of any country, shall not be regarded, of itself as constituting or establishing an alien’s membership in or affiliation with, any proscribed organization, and shall not constitute a ground of ineligibility to receive a visa.  However, continuing service and/or promotion to a higher rank, e.g., the officer corps, could result in the alien’s serving in a political capacity which would be cause for a finding of ineligibility under INA 212(a)(3)(D).

sec9 是要很多其他部门来解释的。我找到的 Foreign Affairs Manual的内容。 但是如果这些部分或者相关议员做了更广的解释。那就不知道了

第二部分，议会的问题。
UC通过的S386已经和house通过的hr1044相差非常之多。除非house拿一模一样的案子再投一次票才可能送到trump桌子上。我们无法排出这种可能。但是一般情况下，senate和house案子有区别，这个案子是要先到一个committee里面解决不同的地方，然后再根据两边一致的案子分别投票。
这是我了解的议会运作方式，如果不对请指正，谢谢。
大家现在非常关注house

这个议会可以投票的日子屈指可数。介于多数党的leader已经给出下个议会的calendar了，我个人认为现议会的session资源非常有限。我个人认为UC没人object是因为大家都知道时间不够了。

10号之后各rep就要回选区活动了。
如果这个案子在所有session结束之前没有敲定，那么到了下一届议会，这个案子就是另一个故事了。

第三部分，打击面的问题。
下面是我援引的485表格的内容
Have you EVER been a memeber of, involved in, or in any way associated with any organization, association, fund, foundation, party, club, society, or similar group in the United States or in any other location in the world including any military service?

Have you EVER been a member of , or in any way affiliated with, the Communist Party or any other totalitarian party?

485表格明确会问这些问题，还有一些军事训练的问题，对于这些当然也可以做一些豁免。

之前没有这个案子，大家为何不去害怕这些问题，这些问题条条都可以扩大到所有七子以及很多高校的学生 乃至 所有在国内上过本科的人。

第四部分 总结。

过度惊慌不可取，如果自己不确定可以去问自己的移民律师，但是如果深信美国政府敌视华人，那所有的文字游戏都可以扩展到所有中国人。

为什么总是有人觉得中美现在的关系是所谓的战狼外交导致的？都21世纪了难道大家都觉得美国的战略分析师和智库人员连data driven analysis都不懂，每天就盯着人说话的语气制定战略吗？

关键问题是这个条款和fairness没有半点关系，夹在里面算什么？
为什么要单独点名中国？美国的敌对国家不少吧。

恐慌是不必，我也不认为民主国家能搞连坐，但是这就是个很坏的信号，也让大家看清楚了共和党的面目，川王连任真的要准备随时回家的

鱼神好样的！没有gop出来反对ead卡过多的问题其实我还蛮惊讶的。也可能就像你说的议员知道时间不够了就算了

不知道如果S386通过，楼主提到的那个帖子中列出的那5个例外情况和豁免是否还可以继续使用。

不是学法律的 但是关于第三条 我的理解是

之前 你写yes / no 多是ymmv 可能过 可能不过 不过大概率 不过 取决于心情
现在因为有这个法规了 你写的是yes 那么按照这个bill 应该就是不过

我觉得bill 和目前某个department 定义区别是 bill 是法律 而某个部分的文件 只是属于指导意见

另外好奇下 你怎么看twitter 上面几个积极参与386律师 都说这就代表和中国人无关的观点?

第二部分 希望你是对的吧...之前大家也是一直觉得386 死了 等明年486来了再战

具体就要看有关部门的解释了

按照当前的解释，打击面不会那么广，作为七子出身的我不是很慌。毕竟现在退役的军人都不算，为啥难为我一个小学生。
