lz可以做下面这几个事情:
1. 首先分析一下你的老板言语不当属于哪个类型。比如:a. verbal bullying or b. harassment or c. discrimination, etc。当然,这需要你首先了解每一类的具体定义。
a. verbal bullying/abuse:
Here are some examples of what normal disagreements look like:
  • They don’t dissolve into name-calling or personal attacks.
  • They don’t happen every day.
  • Arguments revolve around a basic issue. They aren’t character assassinations.
  • You listen and try to understand the other’s position, even when you’re angry.
  • One of you may yell or say something truly awful out of frustration, but it’s an unusual occurrence and you work through it together.
  • Even if you can’t agree completely, you’re able to compromise or move on without punishments or threats.
  • Arguments aren’t a zero-sum game: One person won’t win at the detriment of the other.
Consider it a red flag when the other person engages in these behaviors:
  • They insult or attempt to humiliate you. Then they accuse you of being overly sensitive or say that it was a joke and you have no sense of humor.
  • They frequently yell or scream at you.
  • Arguments take you by surprise, but you get blamed for starting them.
  • The initial disagreement sets off a string of accusations and dredging up of unrelated issues to put you on the defense.
  • They try to make you feel guilty and position themselves as the victim.
  • They save their hurtful behaviors for when you’re alone but act completely different when others are around.
  • They get into your personal space or block you from moving away.
  • They hit the wall, pound their fists, or throw things.
  • They want credit for not having hit you.
b. harassment
  • Sexual harassment: a supervisor asks an employee to engage in sexual activity as a condition of receiving some form of benefit at work (a promotion, a raise, retention in his/her job, etc.);
  • Non-Sexual harassment: harassing conduct and workplace bullying create an abusive work environment for an employee.
c. discrimination
  • Discrimination based on sexual orientation
  • Gender-based discrimination including promotion and equal pay
  • Pregnancy discrimination
  • National origin discrimination
  • Racial discrimination
  • Age discrimination
  • Disability Discrimination
  • Genetic Discrimination
2. 然后,查出你所在州的法律。比如:在加州,verbal abuse是这样的:
Verbal Abuse Is a Criminal Offense in California
One charge used by the state is Penal Code §422: Criminal Threats. Individuals face PC 422 charges if they threaten someone with: An act of violence. Physical harm.
以此类推,你可以找出harresment and discrimiation 的具体定性条款。.google  и
3. 咨询律师,请求帮助。律师可以根据你的case指明哪些行为可以定罪,哪些不可以。 如果要打官司的话,每个州的要求都不一样,所以需要具体查。而且,在米国很多律师最开始的咨询case是免费的。如果确定能打官司,才开始收费。. From 1point 3acres bbs

最后,宝宝们在米国一定不能忍气吞声的工作。不能总是迁就上级unprofessional的行为,尤其是当他的行为伤害到了你的mental health/career。如果因为工作上的事情被逼出现生命危险,真的很不值得。而且,如果上级发现国人不反击,他以后也会欺负其他国人。因为他可以觉得中国人就是好欺负、什么都不懂。。。所以,宝宝们一定要学会反击,法律就是一个有效的武器。

除非是骚扰短信/录音这种能一锤子锤死老板的,建议谨慎。工作上的矛盾锤不死他倒可能让你被开了。

有实锤。可是自己也会在组里呆不下去?公司层面对自己有什么影响呢。有什么更好的解决方法吗。
