J1 waiver 7/30/21 NOS 议员协助

关于J1waiver，我之前有详细的时间线帖子。
经历了congressman的协助失败的痛苦，找了一圈attorney, 都不接我的expedite的request.

还有10天，J1到期。

于是参照地里的帖子，找来NIW I140的模板，24h通宵赶出来了80pages 的statement 和 exhibit。
赶在12：30分别发给了212邮箱和senator。
下午3：13 senator 发来邮件说“The Department of State has made a favorable recommendation as of today.  The case has now been forwarded to the Vermont Service Center of USCIS.  We will continue to monitor the case.”
可是学校还是不愿意在J到期前提交H1-B.

给大家趟了个路。。。。。


补充内容 (2021-10-22 01:39 +8:00):
2021.10.5： 在senate.gov上填写email。
                 12：07pm 办公室职员email我授权信，我填写后发回，并且附上了NIW材料（申请加急的理由和证明材料）
                3:13pm   职员email给我说FR已经sent to VSC.
2021.10.12   议员发信件给我说： USCIS收到FR，但是要处理几周。（信件是当天收到的）
2021.10.15  议员发信件说：USCIS 在10.13 Filed I-612, USCIS不批准我的加急请求, 标准处理时间是2周-6月，提供了我的case# EAC2201550***。（信件是当天收到的）
2021.10.20 10am 参考地里的帖子，我开始给emma聊天，提供了个人资料后，我告诉Tia我要加急I612。然后他们发了一段话。我回复了1 financial loss, 2 humanitarian emergency, 3 non-profit organization, US Gov benefit. 都是一句话概述。Tia给了我一个confirmation号码，说5天后有结果。然后，我请求升级。她说会有人给我callback, 给了我另外一个reference#。
               9pm，顺手一查，approved！
开心！

The submitted evidence demonstrates that:
a.        The timely approval of my J1 waiver is merited for urgent humanitarian reasons
i.        Without timely approval of J1 waiver, I could not continue my work after ..date...., and I have to depart U.S. after 30 days of my J1 expiration date.   
ii.        My departing would result in unpredictable long-term family separation, which would be a grave humanitarian crisis that affects family.....
iii.        My children are medically vulnerable; my kids face elevated risk for COVID-19 infection during the long-distance travel.
iv.        My employment disruption will result in a financial hardship for my family, which deprives my ability to provide for my children’s basic needs, health coverage, and negatively impact their ability to access needed medical care.

b.        I qualify for a national interest waiver. The timely approval of my J1 waiver has national importance
i.        I am a member of the professions holding an advanced degree (PhD) with well training in the professions requesting a national interest waiver of the requirement of a job offer.

ii.        My proposed endeavor has both substantial merit and national importance as a research scientist in ,,,,,field.

iii.        I am well positioned to advance the proposed endeavor, and serving as the main participant in NIH projects.



Specifically, the submitted evidences will prove:

a. The timely J1 waiver approval rescue me from urgent humanitarian circumstances.
    i.        To avoid potential family separation.
    ii.        My kids are medically vulnerable and face elevated risks to COVID-19.
    iii.        To continue my employment at...., so I could pay the food, educational bills, health insurance and medical bills for my kids.

b. My virus-related research is extremely beneficial to the United States

Requires documentation to support the approval of an expedite request (the burden of providing that you meet the criteria rests on you) We may consider evidence that is already contained in your application or petition, and may not require additional evidence from you. We may deny your request based solely off of the information you provide over the phone and/or evidence in your application or petition, and might not follow up to request additional evidence. Has the sole discretion to decide whether to grant or deny a request. Does not consider expedite requests for applications or petitions that have Premium Processing Service available. You can make a request to expedite your case if you can demonstrate that your situation falls into one of the following categories:   Severe financial loss to company or person, provided that the need for urgent action is not the result of the petitioner's or applicant's failure to: (Note: Form I-129, Petition for Nonimmigrant Worker, H-2A beneficiaries pending more than 15 days fall under this category) File the benefit request or the expedite request in a reasonable time frame, or Respond to any requests for additional evidence in a reasonably timely manner. 应该是。

把同一份材料同时email给senator和212。

第一次收到212的人工回复，说FR sent to USCIS.

我也试着发邮件加急，收到的回复是
Thank you for contacting 212e Waiver Inquiries.  The Waiver Review Division (WRD) has an expedited processing track, but it is reserved only for those cases in which there is a significant humanitarian need or in which there exists a clear and significant U.S. government interest.  Based on your email, it seems you are suggesting that your research could represent a clear and significant U.S. government interest.  In order to make this determination, please provide further documentation to support your claim.  This documentation should come in the form of a letter from your current/prospective department/division chair and should outline the following information:

The study/research in which you are or will be involved
Whether or not you are a principal investigator
How much funding for your project(s) (both amount and percentage) comes from official U.S. government sources
How this study impacts the U.S. national interest

我回复给Emma的加急理由：
Dear Tia, I think my reasons are 1) loss of employment made heavy financial loss to my family , 2) I am facing the family separation that it is an  urgent humanitarian emergency to my kids, 3) my unemployment status delayed my NIH project, and caused scientific loss of non-profit organization *****, which is compelling U.S. government interests (打的时候有语法错误，哈哈)

然后， 得到一个号码。That is confirmation number for the expedite that I created for this case.

接下来，我请求上级协助：Please escalate me to a second tier rep to get more specific info regarding my case。
Emma告诉我有人给我call back, 给我了一个号码，I have a service item number for you。

10/25/2021  收到mail, I612 approval notice.
