H4单独回国: 485 pending，已打指纹，Combo/AP没批

状态如题，副申请人，H4签证还有效，能自己单独回国再用H4进来吗？如果在国内时间久，H4签证过期了，能在国内再申请H4签证吗？
背景：
主申请人的H1B有效期到2024年8月，当前已收到Combo卡，不会换工作，不会激活EAD卡。
副申请人的485是单独递交的，已打指纹，国内有急事等不到Combo卡下来（收据开头是MSC，combo卡下来估计要到7月份了）

咨询了律师，回复是灰色状态，让看USCIS的规则 （II. Travel Using H-1B Visa during I-485 Pending ）

麻烦有经验的指点一下。

情况类似， H4已经在国内了，只要H1B的797还有效，即使H4过期应该是可以可以续签的
不过你在拿到combo卡之前回去，131申请应该是会作废的，对485没影响

感谢回复。明白，离美后现在的131申请会被拒。不影响485就可以。只要用H4签证能再回来，再申请131。我的律师发了个文档，说对485也有风险，我没看出来。

II. Travel Using H-1B Visa during I-485 Pending
If an I-485 applicant holds a valid H-1B status in the U.S., the alien may travel and reenter the U.S. with her H-1B visa, if the alien has a valid H-1B visa or the alien applies and receives an H-1B visa overseas during the trip.  Such an alien reentered with an H-1B visa will not be considered abandoned her I-485; she is in valid H-1B status after reentry and can work with her new I-94 with H-1B annotation.  Please note, the alien must possess a valid H-1B status in the U.S. before departure to be qualified for this exception. Before she leaves and comes back with H-1B visa, she needs to work for the same employer.  Her dependents under H-4 status can use H-4 visa to enter and belong to this exception too.  In addition, if you leave the US before your advance parole document is approved, your I-131 advanced parole document application case will be denied.  You can apply for it again in the future if you need it.  Only H-1B/H4 holders can leave the US without advance parole I-131 document is approved.  All other type of visa holders cannot.

II. Travel Using H

我的律师是这么说的

Please be advised if you travel while your Advance Parole document is pending, the document could be denied or abandoned. The Advance Parole application can be re-filed, once you have returned from your travel and do not have any upcoming travel plans for the next 5 months. The denial or abandonment of the Advance Parole application should have no impact on the pending Adjustment of status application. When traveling internationally, you must make sure to carry the necessary travel documents for reentry, such as a valid approval notice, valid passport and visa stamp.

其实可以尝试一下议员催绿 一般如果是紧急状况需要出境 很多时候催131和765 都成功的

律师说催没多大用。只要H4能用，我现在状态是不急着绿。
