人在加拿大，拿美国工资可能吗？

感谢回答！抱歉帖子里没有交代清楚，是已经获得美国合法工作签证并办理好美国bank account + payroll后，再从美国离境，返回加拿大（安省或者BC省）

我其实就是这个情况，TN SSN 银行账号一切完备，但是疫情remote期间公司都必须要把payroll转到加拿大

这种询问帖子为什么也有人踩？！

结论是可以。但除非需要蹲移民监，不然图啥呢？需要去公司上班的话要跨境commute，然后还要两边报税

感觉比较渺茫，就算是有办法操作也是违法的（偷偷越境？）。
倒是见过有人在美加边境住，跨境通勤，一边拿美国工资，一边攒加拿大居住年限拿国籍的。或者像一个有美加双国籍的朋友，因为家人在加拿大不得已每周两边跑的。

Cross the border to work everyday
Canadian address on US Payroll & W2.
Hundreds of PRC, Indian passport holders are doing this way.

加拿大敢闯敢拼的人也不少，最主要的原因是哄抬工资的公司太少了。但是自从可以remote以后不少公司能给us pay，或者只打7-8折，比2年前已经好多了。

但这个的前提必须是 公司地址在美国 且 每天都得来美国上班吧？

因为如果remote 的话 相当于work location 并不是H1B filling 地址？之后renew 或者办绿卡 移民局看出入境记录 发现你没有天天入境美国 估计会找麻烦……

同意，最近工资已经好很多了。。。加拿大人拼这事儿吧，肯定有不少拼的人，但感觉一个是概率上没有在美国的多，另外拼的也有不少直接被吸到美国本土去了，或者说一个拼的人从美国移居加拿大的，比从加拿大移居美国的要少很多。。。

1. It's all up to your company. Some care while some do not care it at all.
2. CBP won't care it at all.
3.  When you renewed your H1b, USCIS only cares whether you physically present in US at the moment when your application gets delivered to USCIS office.
4. USCIS don't care whether you are in the US or not, they only cares whether you work in the LCA location when you are in US.
5. CRA may care it because you actually work in Canada but the payroll is still in the US. But since you are a Canadian Tax resident, anyway you have to pay the difference to CRA, so it doesn't matter.  
6. IRS won't care it as anyway you have to pay all the US sourced income tax.

I have some collegues who WFH in Toronto, they have H1b 797 but rarely come to US office.  My company just put their Toronto address on the Pyaroll & W2.  We didn't see any issues on their H1b extension, they just came to US on the day when lawyer mailed the package, and stayed in US until the packaged was delivered to USCIS.

But some companies who have a Canadian office may not allow it due to company policy and tax issues on their side.
