求问H4 extension pending期间EAD180-day auto extension

看到地里已经有不少兄弟姐妹人肉去边境update i94了，然后利用最新的180天 ead auto extension政策成功争取半年时间。

想问一下如果已经有一份h4 ext 在pending了，还能不能像上面的做法这样做，利用这个政策为现有的ead争取半年时间？有没有人成功了？

我读了读，没觉得需要先update i94，再去提交ead extension。USCIS对于的ead auto extend解释
-“Properly filed Form I-765 for a renewal of your employment authorization and/or EAD before your current EAD expired”满足
- and“Your renewal application is under a category that is eligible for an automatic extension (see the list of categories below)”满足
-and“The Category on your current EAD matches the “Class Requested” listed on your Form I-797C Notice of Action, Receipt Notice.”满足
-“In addition, for H-4 dependent spouses, an unexpired Form I-94 indicating H-4 nonimmigrant status must accompany Form I-797C when presenting proof of employment authorization to an employer for Form I-9, Employment Eligibility Verification, purposes”我的理解也是满足的，因为说的是做I-9验证的时候，出示没过期的I-94和EAD延期申请的 I-797C收据。
-“If you file a Form I-765 renewal application on or after May 4, 2022, USCIS will send you a Form I-797C Notice of Action receipt notice that has information regarding the up to 540-day automatic extension. If you are eligible for the automatic extension, this receipt notice, together with your expired EAD (and your unexpired Form I-94, if you are an H-4 dependent spouse) will serve as acceptable proof of employment authorization and/or EAD validity during the up to 540-day automatic extension period.”

但是看am22tech的博客，H4 i94 is Valid这节“2. End of H4 status OR –H4 i94 has expired but the H4 extension is pending”；Expired H4 i94 Extension Pending这节“You will not get any automatic EAD extension if your H4 i94 has expired.”可能他指的是H4 extension pending的时间段内没有automatic EAD extension。但是H4 extension获批之后就可以了？

对于我的情况，万一H4 EOS在2023.1之后才批，我也不是很介意2013.1到H4 EOS获批那段时间的gap，只要在H4 EOS获批后，我可以使用automatic EAD extension就好。

换句话说，就是automatic EAD extension是否要求从EAD extension file到EAD extension获批期间每一天都有有效的I-94？还是只需要在这期间想开始工作的时候有有效的I-94就行了。

需要吧 EAD上班的前提是你每天都要有合法的H4身份 包括automatic extension期间 这也是你填i-9的要求之一  所以你应该在H4过期前去边境 renew i-94

我是h4和ead同时过期、所以几个月前就同时file了h4 ext和ead。我刚刚学习到…人肉去边境需要valid visa stamp，境内转的这种不行，出去就回不来了。

据说在境内也可能会给你更新I94的，前提是h1b已经approved了，不过要去碰碰运气。

像你这种情况，假设你能在境内更新I94，你的EAD就能自动延期180天吗？

我的理解是你需要先更新I94，再提交EAD申请，这种情况下才会有180天的自动延期？不知道哪种情况才是可行的。

不是先file h4 ext，你现在单独h4 ext也至少得半年吧（还不能保证），1）是你现有的h4本身就是很久以后才过期，但是ead马上快过期了 2）像其他帖子里一样人肉拿valid visa stamp去边境更新i94，然后回来提交ead ext。

你Google一下h4 ead 180-day auto extensione，很多律师网站都有一些QA
