美娃只能豁免党员 写在移民法INA § 212(a)(3)(D)(i) The Attorney General [now Secretary of Homeland Security] may, in the Attorney General's discretion, waive the application of clause (i) in the case of an immigrant who is the parent, spouse, son, daughter, brother, or sister of a citizen of the United States or a spouse, son, or daughter of an alien lawfully admitted for permanent residence, for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, if the immigrant is not a security threat to the United States

其他类型的豁免条件不一样 非法滞留对应的豁免条款是INA § 212(a)(9)(B)(v) The Attorney General [Secretary of Homeland Security] may waive clause (i) in the case of an immigrant who is the spouse or son or daughter of a United States citizen or of an alien lawfully admitted for permanent residence, if it is established to the satisfaction of the Attorney General that the refusal of admission to such immigrant alien would result in extreme hardship to the citizen or lawfully resident spouse or parent of such alien. 里面没有美宝

而且unlawful stay的豁免还需要证明父母或者配偶因为你的离境会承受extreme hardship。老川现在很多情形都不认。

我觉得吧，开290，继续工作，290批了一笔勾销，290拒了你也没回头路，离开美国了还谈什么非法不非法工作，至少这些天还有收入来源。

"citizen or lawfully resident spouse or parent of such alien" - 如果配偶是H1B甚至H4的话也没用啊，而且楼主要是有公民/绿卡配偶的话还来折腾EB1B干啥
