【H1B申请期间回国】&【OPT期间回国】

楼主背景如下：

• Non-stem专业，去年15年12月毕业
• OPT是15年12月—16年12月
• 目前在一家公司full-time
• 五年F1 visa到2020年
• 今年16年4月申请H1B

楼主因为家庭原因今年4.10-4.20要回国，4月20号回美国，那么问题来了：


因为不用回国续签F1签证，所以就是买机票来回出入境，可是四月份的时候我既是OPT期间（OPT到12月，所以没有cap gap的问题），又是h1b申请期间，那时候回国出入境有风险么，风险是什么？

我4月20日以F1回美国入境是否有问题？因为现在full-time工作，有EAD卡和offer letter。

Travel Restrictions

USCIS rules are clear that you cannot travel internationally while a change of status request is pending, as that would be considered an abandonment of the COS request. Therefore, after we file your H-1B COS petition on April 1, 2016, you should not depart the U.S. until USCIS approves your H-1B petition. If you do travel outside the U.S. while your H-1B COS petition is pending, USCIS will approve your petition, but not approve the change of status. As a result, you would need to depart the U.S. until such time as you can reenter the U.S. after applying for an H-1B visa at a U.S. consular post abroad in order to make your H-1B status effective

Even after your H-1B petition is approved, we recommend that you do not travel abroad until you plan to reenter the U.S. with your H-1B visa.  Once the H-1B petition has been filed, your nonimmigrant “intent” may be affected. F-1 status is strictly a temporary nonimmigrant status and does not allow the status holder the ability to pursue long-term or permanent residence in the U.S. When you applied for the F-1, and each time you entered the U.S. in F-1 status, you declared your intent to remain in the U.S. on a temporary basis. H-1B status, however, carries dual intent: you can remain in the U.S. on a temporary work visa, but you can simultaneously pursue permanent residence (a “green card”). Since F-1 status does not carry this dual intent, issues may arise upon entry to the U.S., as immigration officers can access the USCIS database, which will show your pending/approved H-1B petition. Therefore, if you attempt to enter the U.S. in F-1 status and a U.S. border officer sees that you have an H-1B petition pending/approved, you may be denied entry to the U.S. since the H-1B petition conflicts with the temporary intent required under the F-1 visa category.

楼主，我也是今年申请H1B, 我公司的律师说，由于你现在是F1签证，申请H1b以后在移民局会有记录，等你入境美国的时候，会在入境处查到你有H1B的petition，但是同时你又要用F1签证入境，因此入境officer可能会以来你入境的目的矛盾拒绝你（F-1非移民，H1B移民），因此我们公司的律师说三月到十月有international travel最好取消，不能取消的话，要和公司律师商量。建议楼主还是最好问问你们公司的律师这件事情要怎么处理。

非常清晰！感谢！

H1b也是 non-immigration visa，H1b本身不构成移民倾向。只能说，任何时候回都是有风险的，被拒签或行政检查。我这边的律师解释则是如果要离境就选择 Consular Process，身份会一直是F1直到离境后签工作签证，即使是10月以后也是一样，还可以继续申请OPT EXT直到完全用完，这样可以省很多税和H1b时间，当然啦，是不建议玩火的，尤其是要办绿卡的人
