why first year should be fine？

One of my friends' boyfriend OPT first year, 5 weeks. Get H1B approved and successfully go back and come back (yesterday), no one ask. I think they should have a standard for this based on how long and which opt are you in. And I also think since the first year you can have no pay or do volunteer, it should be fine.

US.C.I.S knows this for a long time, F/S is not under investigation for this rather than for the spy. So if your time is not that long (let's say 3 months? I don't know), and you do not do it in your STEM (under penalty of perjury), it should be OK.

One of the guy's aother friend will be back in New Year, and almost the same situation and case. I will keep posted if this guy come back successfully.
