反对信如下：

Dear (XXX office staff),

My name is (XXX), one of (students/alumni) who graduated in (XXX Year). I'm writing on behalf of many international students and alumni who are concerned with a recent Senate Legislative Bill (S386) – ‘Fairness for High-Skilled Immigrants Act of 2019’. Its companion Bill, HR1044, has passed House earlier this year, and Bill S386 will be voted with Unanimous Consent by Senate next week.   

Unfortunately, this Bill S386 – ‘Fairness for High-Skilled Immigrants Act of 2019’, is totally misnamed and cannot be considered ‘fair’ under any circumstances.   

If enacted, S386 will severely reduce diversity across all communities, industries, and academia. The purpose of this legislation is to cancel the 7% ‘Per-Country Cap’ for employment-based green cards without addressing the root cause of the backlog. This initiative will enable almost 100% of available green cards to flood into the largest country, India, alone and deprioritize workers from all other nations. For many years, even decades to come, nationals from 190+ other countries will be locked out and suffer from unfair waiting time.

During the past few weeks, S386 has rapidly raised panic among international students and workers who are not from the beneficiary country. This bill not only discourages alumni who are already waiting in green card queue, but also hinders prospective students from serving the U.S. society with their talent in the years to come. With such difficulty, our gifted students would have to leave the country shortly after graduation, which will be a heartbreaking news for both students and the university.

Another serious consequence of S386 approval is the increasing of the long-standing abuse of H-1B work visa. According to New York Times, outsourcing firms are playing with the US job market and our visa systems. In 2014, almost a third of total H-1B visas are sponsored by 13 illegal outsourcing firms, which are majorly based in India. Should S386 be passed, this H-1B abuse problem would be seriously deteriorating without the limit of 7% ‘Per-Country Cap’.

While we do understand that the current Green Card system is not perfect, evidently S386 is not designed to improve the system in any aspect. We would sincerely like to call for your awareness of the bill S386, and the substantial harm it may cause to the international students and alumni of (XXX). We respectfully look forward to your response to addressing the concerns of the international students and alumni, and make our voices heard.

以下是我写的段落，用来解释H1-b对美国经济的帮助，Backlog是由H1-b Fraud导致，S386是在鼓励欺诈者，最终将伤害美国劳动力。我希望通过这个逻辑来取得美国工人的支持，同时说明错误不在于高技能移民，而在于欺诈移民规则的人。欢迎酌情使用。

The main reason why the current high-skilled employment-based visa system (aka H1-b visa) is putting more low-wage guest workers onto the path to green card is because it has failed to identify real high-skilled professionals to play key roles in all industries for the economic competitiveness of the US, which is the original purpose of this system and was definitely welcomed by both real foreign professionals and the American workforce.

However since about 2013, if not earlier, frauds flooded the system because of the potential benefits for the Big Techs by acquiring foreign employees on low-wage positions regardless of their skill level and the immigration authorities’ failure to stop this abuse of the system in time, thus, leaving a huge backlog in the queue for green card within a specific group. As a result, this backlog of green card applications includes a significant number of candidates who cheated the H1-b visa system to get whatever jobs and are not high-skilled workers that only work for specific positions in their professional fields.

Before the bill S. 386, the per-country cap can still to a degree control the portion of those who are coming for a low-wage job from acquiring green cards to compete with the US workforce. There is also a chance left for those who really fit the qualifications as high-skilled professionals who will contribute to the growth of US economy. Now the bill S. 386 is easily sneaking through the senate as fast as it can be without a public hearing just because a few companies have enough money and motivation to hire enough lobbyists on the hill, while the organizations like UAW going through tough negotiations and calling strikes for the welfare of US workers in Michigan. I hope we can take some time to educate the public about the truth of the bill S. 386 and its twin HR 1044 before it is too late since these bills are titled with fairness yet ironically rewarding those who have broken the rules and frauded the immigration system in the first place.

The obvious fair resolution for these bills is to order public hearing and debate on them.
