Today, Present Trump issued the Executive Order (EO) suspending the entry into the United States of aliens as immigrants for 60 days (with the possibility of extension). The EO does NOT affect the filing, processing and approval of I-140 (EB-1A/EB-1B/EB-2 NIW), I-130, I-485, I-765 (for Employment Authorization Document), I-131 (for Advance Parole) and I-129 (H1B/O-1) within the US.

If you're outside the U.S., the EO does not affect your capacity to file I-140 or initiate the immigrant visa processing but you won't be able to obtain an immigrant visa. That being said, considering it takes 6-12 months for the USCIS to process I-140 cases and 6-10 months for the National Visa Center to process immigrant visas, by the time you reach the step of getting an immigrant visa, the EO should have expired. Based on the information provided, it is expected that this is a temporary suspension.

We have also received many questions regarding the USCIS processing time during the COVID-19 pandemic. Currently, the USCIS continues to accept, process and approve I-140, I-765, I-131, I-485 and I-129 cases. The processing time does not seem to be affected by the pandemic. So far this month, our firm has received around 250 I-140 approvals.

Although the USCIS has suspended fingerprint appointments and interviews, some of our clients received I-765 and I-131 approval without fingerprint appointments and I-485 approvals without interviews.
