USCIS 10/02 更新了有关党员Inadmissibility的内容

重新强调了党员的问题, 并且修改了Policy Manual.主要内容包括

• Provides guidance regarding the ground of inadmissibility based on membership in oraffiliation with the Communist or any other totalitarian party, and USCIS determinations on membership in or affiliation with such an organization.
• Provides a step-by-step overview of the inadmissibility determination, as well as guidance onevidence and burden of proof, and applicable exceptions and waivers.

2. 如何判定membership和meaningful
Membership may be established by evidence that the alien was issued a membership card, paid dues to the organization,[34] or even based on witness testimony regarding an alien’s membership in the organization (including seeing an alien’s name on membership records, dues records, and testimony regarding meeting attendance).[35]

An alien's membership or affiliation is meaningful if the evidence shows that the alien is aware of the political aspects of the proscribed organization during the time of their membership or if the evidence shows that the alien engaged in party activities to a degree that substantially supports an inference of his or her awareness of the party’s political aspect.[45] Accordingly, an alien’s knowledge or awareness of a communist or totalitarian party’s political nature is sufficient to establish that an alien’s membership is meaningful.[46]

3. Exceptions
The first category of exceptions applies to aliens whose membership or affiliation is or was:

• Involuntary;
• Solely when under 16 years of age;
• By operation of law; or
• For purposes of obtaining employment, food rations, or other essentials of living and where necessary for such purposes.
  

An alien may be excepted from inadmissibility under INA 212(a)(3)(D) if the alien can establish that:

• His or her membership in or affiliation with a proscribed organization terminated at least 2[63] or 5 years before the date of receipt of the application (if the alien’s membership or affiliation was with the party controlling the government of a foreign state that is a totalitarian dictatorship as of such date, the alien must establish that his or her membership or affiliation terminated at least 5 years before the date of receipt); and
• He or she is not a threat to the security of the United States.[64]
  

BAL是这样处理的，给大家参考。

在问卷的时候问的是是否参加过少年队，共青团和xxx。前两个组织其实也是xxx的一部分。不过485表格上并没有明确指出少和青是不是，所以是个模糊的地带，我见到有人面试被问少和青的事。如果你只参加过少和青，485可以写no。但是要为面试准备一个合适的答案，为什么加入少和青，不要当场懵圈，更别糊弄面试官。少xx，大陆学生都加过的，被问到是逃不过去的。

第二如果已经离开xxx五年以上，一般是没问题的，律师为485又加了一个附件自白书，就是我什么时候加入的，为什么加入，我没参加过政治活动，我只是学生，没在国内工作过，六年前我就不交钱了。所以我放弃已经五年以上了。我不认可xxxx，不同意xxxx，不相信xxxx，三不保平安，就这样吧，其实感觉有点失落…

补充一点，大陆学生成绩单上都有军训和军事理论，这个可以不算真正的军事训练，但是面试被问到需要准备良好答案应对。

关于前两个组织的面经，网上非常多，律师不会空穴来风。只是提示大家面试好好准备！不要慌张，但只是不要盲目乐观。

你可以报, 但是证明是16岁以下加入的burden就落在你头上了

感觉就是把以前得约定俗成得东西写成了个机器能看得明白得步骤给那些uscis大妈们一步一步跟着做，没有什么新得东西
