H1b 最低工资提高到45th percentile & 如何计算45th percentile

新regulation把H1B最低工资提高到45th percentile。

其中有一段描述在Page 81

“The Department acknowledges that the existing wage levels – set at approximately the 17th, 34th, 50th, and 67th percentiles – have been in place for over 20 years, and that many
employers likely have longstanding practices of paying their foreign workers at the rates produced by the current levels. Adjusting the levels to the 45th, 62nd, 78th, and 95th percentiles
represents a significant change, and may result in some employers modifying their use of the H1B and PERM programs. It will also likely result in higher personnel costs for some employers,
as detailed below. However, to the extent employers have reliance interests in the existing levels, the Department has determined that setting the wage levels in a manner that is consistent
with the text of the INA and that advances the statute’s purpose of protecting U.S. workers outweighs such interests and justifies such increased costs. ”


Q: 如何计算45th percentile?
A: 目前没有看到具体到45th的来源。但是有两个地方可以查找50th工资，一个是https://www.flcdatacenter.com， 另一个是https://www.bls.gov/oes/tables.htm。


flcdatacenter：在search wizard里面选择自己的地区和职位类型会显示出level 1到4的wage。这里面有个问题，level 3是average wage还是median (50th) wage?

USCIS和DOL的Level 3 wage是50th percentile，但是flcdatacenter上显示的Level 3 wage好像是average wage。拿 Chicago (Area code 16980)的Economics Teacher，Postsecondary (OES code 25-1063)举例。flcdatacenter上显示的Level 3 wage 是 $128,573 （https://www.flcdatacenter.com/Oe ... 63&year=21&source=1）， 但是点击 25-1063.00 进入Summary Report，然后在最下面的Wages & Employment Trends里点击go，你会发现一个表格，显示了10th, 25th, 50th, 75th和90th对应的wage。（https://www.onetonline.org/link/localwages/25-1063.00?st=IL&g=Go）这里面的50th的wage是$110,890，显著低于之前页面上的Level 3 wage $128,573。

直接下载OES数据（National）查找自己的地区和职位，然后能看到10th, 25th, 50th, 75th和90th对应的wage。这里的50th wage和flcdatacenter里summary report 下面的50th wage是一样的。45th wage其实目前没找到具体数值，只能大概用50%和34%来估算, 工资不是平均分布，不好直接算。



个人观点，flcdatacenter的Level 3 wage可能并不是50th wage，但是内心有觉得flc不应该是错的，欢迎不同的看法和讨论。

DOL好像是基于L1和L4来计算L2和L3的工资。例如L1工资50K，L4工资110K，那么推出L2和L3工资70K和90K。依据是新regulation的Page 15.

.. 是啊，然后LV2又比LV1多了不少，希望那些因为过了一点线而沾沾自喜的能认清楚形势

是第5个decile的average，不是整体的average。flc的data应该是准的
之前的算法level 1是整体wage distribution的前1/3的average，level 4是后2/3的average，所以33/2大概是17，67/2+33大概是67

www.bls.gov上EOS数据里的mean wage和flc上的Level 3 wage是一样的。不知道如何解释。
补充一下：根据“the existing wage levels – set at approximately the 17th, 34th, 50th, and 67th percentiles”，USCIS 理解的fifth decile是bottom 40%-50%，那fifth decile的average应该低于median wage。

再补充一句，大部分情况下已经申请过h1b的可以看看自己的LCA，甚至以level1申请的都很少，因为公司怕被reject，所以大概率可能都不止是45%，而且更高比如62%

那些刚过LV1 线的人 你们申请延期的时候 几年的工作经验 然后LV1 肯定是不行的
