主要就是吐槽..大致是在一个月中salary调整超50%，不同行业一刀切level设置不合理，只统计base不考虑整个compensation，要知道很多ceo都只拿1元年薪，调整影响现有工资体系，并且造成人才流失，大大损害美国公司的正常经营，对美国员工无帮助，只会助长out sourcing之类。

不过发了怎么也找不到评论在哪里，不确认是否是规范的comment

刚刚在 涨工资proposal 里发表评论如下：

I am strongly against this proposal. This proposal does not reflect the actual wages earned by U.S. workers similarly employed to foreign workers and would almost completely blocks international talents going into U.S. employment market.

First, the new salary requirement is not a real reflection in the market. For example, the new Level 1 wage minimum will be higher than the previous Level 3 wage minimum in Seattle. It is not possible for most level 1 engineers to gain such a high level of salary. This proposal only increase companies' hiring burden and makes it is almost impossible for them to hiring aliens. U.S. has the highest reputation of education in the world which attracts talented students all around the world to come to U.S. for studying. I believe the purpose of providing education to international students is not only to earn tuition, but more importantly to attract real talents to contribute to America and make it greater as how international people have done in history.


Second, this proposal creates an unfair recruitment advantage for giant companies over small companies and startups. The proposal forces small companies and startups to narrow down their candidate lists because they cannot meet such an unrealistic wage minimum to sponsor aliens to work for them. On the other side, giant companies may still be able to meet the requirement and hire international talents. As a result, there would be a systematic competency inequality between giants and startups. This is against the free market principal of United States.

I am strongly against this proposal as the "specialty occupation" requirement would place an incredible difficulty for companies to hire qualified candidates.

Take my company as an example, we has positions open for cyber security professionals every year. However, there are only a small number of schools in US providing a cybersecurity master degree program [1]. Often, it is difficult for our team to find qualified candidates graduated from a cybersecurity program. Instead, we find people graduated from computer related programs and with cybersecurity project experience or focus are a better fit of the position. I believe this situation exists in many industries, but not only cybersecurity. Academic programs don't not always completely align with available positions in the hiring market. I believe in American dreams as other people in U.S. do. We believe that we should be defined by our skills but not by our backgrounds on paper. If the limitations in the proposal are implemented, it will largely narrow down companies' hiring choices and hurt the U.S. economy eventually if companies are restricted too much in hiring and are not able to gain real qualified talents.

I strongly disagree with this proposal. The core statement in this proposal, "the existing prevailing wage levels set a wage floor substantially below what similarly employed U.S. workers make in many instances, which allows some firms to use H-1B workers as a low-cost alternative to U.S. workers." is absurdly wrong and unreasonable. The current job market in the U.S. is very unfriendly to foreign workers already because most companies do not want to pay extra money to sponsor for their work visas and are concerned about the instability of H1-B lottery systems. Therefore, every foreign hire is under employer's careful consideration and strong desire of the talent brought by the foreign worker. The new rule

According to this article (https://www.forbes.com/sites/art ... risis/#422b8908f0a2), America is losing the competition to China and India because of lack of American STEM students. Another article (https://www.washingtonpost.com/o ... 5017c36f_story.html) also suggests  that U.S. STEM graduate students are mostly foreign. Most of the STEM students in the U.S. come from China and India. If the government raise the wage rule, it will only make it harder for the U.S. companies, especially tech companies, to hire enough workforces, especially entry-levels. It may lead to serious economic and STEM crisis. The reasons are as follows.   

With higher wage standards, many more STEM graduates cannot get a job in the U.S., eventually they have to go back home, most of which are from China and India. This will only lead to the loss of STEM talents in America. Given that American students are generally not interested in STEM, America will lose the talent competition to other countries and the long-term result is unimaginable.

Second, if the foreign students see that it is even harder to stay in the U.S. with work visa after studying here, they will be very likely to turn to another country for study abroad. As a result, the American universities will lose a large amount of money from tuition and many small businesses that benefit from colleges and a thriving body of foreign students will also suffer. The economic impact of it is serious.

Lastly, when tech companies cannot hire enough people, especially entry-levels, in the U.S. because of the unreasonable wage rule, they will outsource their jobs to cheaper labor forces in Asia, just like what happened in the manufacturing industry. This will result in higher unemployment rate, which is the opposite of what this proposal wants to see. In the end, this will only make it worse for the U.S. job markets.

I strongly disagree the DOL's new proposal. First, I think the purpose to protect American workers is good, but in reality the proposed change will do harm to the U.S economy and eventually harm the job market.

1. By raising the Prevailing wages too high, it will make employers hard to hire candidate to fill the job vacancy.
The original purpose of the wage requirement with H1B is indeed to protect the American workers, but it is by requiring H1B workers are paid "no less than what U.S. workers similarly employed in the occupation are being paid". By raising the Prevailing wages too high, the employers get too hard to hire a candidate to fill the job vacancy. Potentially, a large amount of this kind of jobs will just "disappear". Either the employers have to cut the job and drop its relevant service/products, or they can "out source" it to other country, just like what they did with manufacturing jobs. This is especially true in the STEM related area. (Note that every year, the graduated STEM students are too less compared to the job market's need. That's one of several reasons why U.S is promoting the STEM education.)

2. By giving a hard time to the H1B applicants, U.S. is potentially sending another Elon Musk to other country, who has created tens of thousands of jobs. Raising the required prevailing wages to this high just makes it too hard for them to find legal ways to stay in U.S. Among these H1B applicants, a large amount are with advanced degree. H1B is basically a talent pipeline for the U.S. Think about Elon Musk, with paypal, SpaceX and Tesla etc., how many jobs have Elon Musk made for U.S workers, how much does his ambition contribute to the U.S economy? Now think about Sundar Pichai (Google CEO), Satya Nadella (Microsoft CEO), how many jobs have they created? How much do they contributed to the U.S economy? The list can go very long. However, if H1B gives them a hard time at the beginning, these would be very hard to happen. Not every H1B applicant will become Elon Musk, but they do contribute to the U.S economy and eventually that will make more jobs for the U.S workers.

Therefore, I hope the DOL reconsider the proposed change to the H1B rules.
