湾区卖房被realtors威胁强迫签字purchase agreement的可怕经历

不想再每天活的提心吊胆。

这是我有生以来过的最不感觉平安的平安夜。 昨晚快半夜12点时候一辆车停门口， 几个穿hoodie人走下来在我们前院走来走去和拍照， 然后开走车了。我已经报警。报警的email attached below。

基本上一晚上没睡 所以报警写的email都很多typo。也附上了之前收到的一些骚扰和威胁邮件的报警。

我以为打官司就是双方诚实的展示证据，谁知道她们打官司也不老实走法律程序，而是各种dirty tricks。我们律师对他们的所作为也是非常shock. 比如他们威胁要投诉我们律师来试图给他带来麻烦， 让他停止帮助我们。 我们律师说他们这位律师的各种行为unethical and despicable。 他们原本的一个白人老爷爷律师官司打到一半withdraw了， 可能是还有职业道德， 没办法帮他们做这些违法的事情。

这是我人生中第一次打官司。很长时间都压力非常大，受了很多很多委屈。可能今天写的也不是很逻辑通顺。
我们遇到过多数realtors都很好 只有A和X这两个人是例外。
可能之前遇到的realtors都很好，我完全没戒心。之前买卖房子的经验都挺正面。 买房agent别人都是答应几个点的rebate就多少，没有说夹带骗签字改rebate的。 帮我们卖房子的agent也是非常好，所有stagging房子完全没有让我们操心， 我们当时在国外一个月，那位agent就整理好所有offer列表给我们。 和这两个人，我们当时商议买房rebate时候只是口头说定1%， 没有马上写书面协议。后来房子买到后，她们在其他文件后夹带一个备忘录把1% rebate直接降到0.5%， 我以为是签字其他文件就一起签了。她们就骗到这种程度。
我选了它们来买卖房子是因为认识X这个人六七年了， 看她朋友圈感觉她挺温和贤惠的。我对她一直很善良很友好， 所以想不通为什么要在卖房时候这样坑我。她从18年开始就时常问我有没有买卖房子需求或者请我帮推荐给朋友。 于是我们这次小房子换大一点房子时候就想到了她，跟她一起开始买卖房子的事情。 我真的非常非常后悔我的选择。选择了它们直接导致了我们搬来新房子后没过过一天安心的日子， 一直活在它们的骚扰威胁中。可是人真的太难看出来真面目了， 朋友圈全是各种岁月静好，人畜无害。后来看了一个女杀人犯的故事发现原来真有这样一类人。我就是个傻子，一开始那么信任她。
她们告诉buyer有八个offer， 但是在disclosure。io上给我看的只有三个。我反复追问她们有没有给我们看所有offer， X说有一些没有意义的offer她们就帮我们拒绝了。

我们对他们给我们看的几个价格都不满意。她们一直劝我们， 一直到晚上一点还在发消息， 第二天早上七八点又继续打电话。说来说去就想我们卖给她们dual agent那个buyer。

她们说她们buyer有另外一个房子接受了他的offer早上10点必须存定金了， 在9点40发来一个counteroffer让我们签字，说不然的话他就去存另一个房子定金了。 另外由于她们在发来counteroffer时候并没有给我们看过purchase agreement， 我们以为这个counteroffer只是商议价格， 不是binding contract。
后来一搜她们buyer的background， 发现作为来美国读硕士的人有两个criminal records和数个foreclosure记录。 想想觉得很奇怪，怎么会帮我们精心挑选了这样的buyer。 觉得事情很蹊跷， 就根据她们提供的房子地址打电话问了据说接了她们buyer offer的另一个房子的listing agent， 结果人家根本没有接受过她们buyer的offer。

由于我们发现它们用fraud方法骗我们签字counteroffer 所以我们马上就取消了counteroffer， 并且也拒绝签字 purchase agreement， 他们就持续一直威胁逼迫我们签字。并且明知道我们已经发了email cancel counteroffer，还强行要来做appraisal （我们listing时候给她们两把钥匙， 她们只还给我们一把， 我怀疑她们是不是想留一把趁我们搬走后偷溜进来做appraisal）。 我清楚的告诉她们， 我们律师已经在handle， 所以是buyer和seller双方律师在handle， 他们不需要不停的找我。 但是她们完全不停止， 还是打电话威胁我说，要么赔他们buyer一大笔钱， 要么就签字， 要再不签字它们buyer就要sue我了。A还总是装作没有收到我们律师的回信， 不停打电话要给我推荐”好律师“。 不停的种种骚扰和威胁，给我造成非常大的精神压力。有一次在我们拒绝签字并且拒绝赔它们钱， 说谢谢她们的建议后， A说”最重要的是保护好你的家人“。 我当时就非常震惊的问她是不是在威胁我， 她也没否认，就继续讲他们buyer有多大的损失我们要赔他，以及如果我们去法庭， 钱都给律师了。 我知道她们认识我的孩子， 所以很担心。 但我当时以为她只是说说， 也是心软的人， 就没有马上报警（很后悔当时没有报警）。 谁知道在我搬进新房的时候， 它们还来抢我们新房子钥匙。 搬新房子的时候，他们疯狂的向seller agent打听我们什么时候搬家。 在她们威胁我之后我已经告知seller agent她们不再代表我， 不要告诉她们我们的信息。在我多次拒绝他们帮我拿钥匙后， A 还发邮件让seller agent把钥匙放combobox给她密码。 我才知道她们对我的威胁不仅是说说。 于是我申请了TRO.

在对他们的TRO生效之后， 我就从收到她们实名短信电话邮件骚扰变为收到大量各种匿名骚扰。 Aug 11我收到了人生中第一个勒索邮件， 说我必须在72小时之内打钱到xxx， 不然就曝光我隐私， 因为他可以控制我的devices。由于X的老公是有十几年cyber secruity经验的工程师， 所以我真的很担心， 就把这个邮件发给警方报警了。 在A的老公和她们buyer看我LinkedIn之后， 就雨后春笋般大量的假帐号骚扰我。很多有恐怖的头像的账号看我的LinkedIn。比如像这种creepy accounts ：） 也会有很多假帐号， 0个connections的，名字取得和A的老公的first name的特殊拼写一样的， 甚至还有一个假帐号叫它自己”real estate agent“。 我用了十年linkedin， 在跟他们打官司后开始收到这样大量的cyberstalking。

有些假帐号做的还蛮用心的，如下这个简历做的。 这些假帐号pattern是一两天就deactivated。

另外，每次hearing后骚扰也特别严重。 Sep 16 hearing后permanent restraining order granted， 他们就发了带有死亡威胁性质的email “are you still alive？”， 并且开始了non-stop Facetime call的骚扰 （私家侦探说这种一般是买第三方专门骚扰， 很难track back到她们）。 我只能在被骚扰一段时间后换掉了用了十多年的手机号。 Oct 19 hearing后二十分钟之内 我正在和我律师打电话， 结果被拖进一个群聊 非常不好的内容。 Dec 14 hearing完， 他们file的一堆无理motions被denied后， 他们甚至在法庭里故意走过来到离我们很近的地方挑衅。然后继续很多fake accounts， phishing emails， text messages骚扰。 甚至到了像昨晚那样半夜有人在我们家前院闪光灯拍照的程度。

最近总是很想哭。我觉得自己很traumized， 以后不敢随便相信别人，也觉得不能让别人觉得我是好说话的人。
有时候觉得我为什么要遭受这一切？我最近开始做新工作，三个孩子上新学校要适应，我还得应付打官司和她们的各种骚扰威胁。 我觉得最近好累啊。我做的工作也是对社会有益的， 人也算nice， 火坑专业转行后也热心帮助其他人。不知为什么要遭此报应， 被无辜卷入官司。

每次看到孩子们纯真的笑脸， 听到她们可爱的话语， 心里都很酸楚。 有时候责怪自己不会识人， 选了这样的agent， 没有保护好我的家人。 把我们全家拖入这样的灾难。 目前打官司几个月花掉买一辆特斯拉的现金， 也没有钱出去旅游了。 娃们也挺郁闷过节只能在家不好玩。

我幼稚的人生观是以为她们如果守法的做生意， 给我找到最好的买家， 我以后也会给她们推荐朋友。 但她们好像完全不在意reputation， 她们觉得还是邮寄大量postcard管用吧。好像根本不在意口碑，是骗到一个算一个的态度。 deal with她们 处处是陷阱， 一不小心被它们刻意误导签错一个字就会被坑惨。哪里还敢找她们卖。所以我们当时坚决不让她们卖了。

这样的人只能预防， 一旦沾上了不管怎样都是输。 打官司赢了，她们就用下三滥手段继续骚扰和吓唬。想要过安生日子，要不被他们骚扰，就得无端的赔他们一大笔钱来买。 我以前做梦也没想到， 买卖房子遇到不好的经纪居然能生命财产安全都不保。如果说买房过程是terrible， 卖房的时候就是HORRIBLE。之前压力很大在一个群里吐槽了一下， 还有她们的朋友截屏给她们，A还拿去法庭上说我诽谤。 可我说的都是事实啊。 难道不是我们不肯签字purchase agreement她们就威胁骚扰吗。 这些都在提交法庭的证据里啊。 她难道不是服务超级lousy，带我去看房子还问我有几个卧室， 我还得给她讲解吗？验房报告从来不愿看，每次要求半才天勉强跟你说说， 通常就说她看了没有问题。

目前我很担心，不知道无所不用其极的人还要做什么事情。回头看来，当时即使亏掉七八万earnest money也该终止不跟她们买房子。更不该跟她们卖房子。因为遇到这样的人，现在打官司花费都远不止七八万。

新年里，希望能少收到威胁和骚扰， 生活恢复正常。

After RO granted: DEC 23 1123 PM someone at front yard took pictures
Hi Jason,
I hope this email found you well. As I reported to you earlier, there were two persons had permanent restraining order to stay away from our family (please see the RO in the attachment). However, there were severe harassments by horrible emails, non-stop facetime calls after the RO was granted.
A and X were not happy about the outcome of RO hearings. They filed Motion for reconsiderations,  Motion for new trial, and ex parte to stay the RO pending until they appeal. All their motions got denied in the Dec 14 hearing. In addition, they also sent out 6 subpoenas requesting all my communications with my attorney on the RO case which were absolutely frivolous. When our attorney filed a motion to seek for sanctions of their frivolous subpoenas, their attorney filed withdraws for the subpoena. Our attorney made it clear in the Dec 14 in-person court hearing that the respondents continued their harassments by abuse of legal procedures.
Right after the hearing, the Judge purposely separate us by letting the respondents, A''''''''''''''''s husband and their attorney to got to the elvator first to leave the court. Then it was our turn to leave the court. However, when we got out of the elevator with our attorney, we found they all came back after they left the court and they were going throught the safety check again in order to get back to the court. After they passed the safety check, they walked very close to us. I had to walk to the other side of the room to avoid getting so close to them. After we arrived at home on Dec 14, around 3:45 PM, there were two people walking around our house ( please see the attached colored pcitures). They first walked in the other side of the road and then cross the street to walk in front of our house and they both turned their heads towards our house like they were observing something.
The next few days after the hearing, there were so many phishing emails, text messages, and fake accounts viewed my LinkedIn profile. Some fake account even messaged me. These activities caused me a lot of stress! I am seriouly very worried about myself and my family''''''''''''''''s safety.
What is even worse, last night, there were more suspicious activities. On Dec 23 around 11:23 PM, there was a white car arrived at our house and parked. Three people walked out of the car and walked around our front yard to take some pictures. You can see the flash light from camera in the first video below. This group of people drove away after a couple of minutes.

Sorry to bother you. I got more harassment to report. Please see the attached document for details of their crazy Facetime attack of calling me over 15 times non-stop in one our last night around 9:30 to10:30.   The harassment has reached an unbearable point. They continued to harass us because they thought what they did was not traceable.

I have you are doing well.
I reported to you on Aug 12 about a blackmail email sent to me after I filed TRO against A and X for civil harassment. The harassment continues.
On Sep 16, permanent ROs against both of them were granted after the second hearing (please see the attached RO). However, I still receive harassment email after RO was granted as shown below. There is also more fake account cyberstalking me on LinkedIn as shown in the screenshot in the attachment called "Sep 18 disturbing email and fake account view". They were intensively harassed me. There were many fake accounts created to harass me on LinkedIn ever since the TRO was granted. Please refer to the supporting documents attached which were the documents I filed with the court for their previous harassment and threaten.
Could you please have an investigation to figure out who has been harassing me all the time? I really hope they can stop harassing me. It seems they continue after the RO was granted because they thought these disturbing behaviors I could not trace back to them (seems like X''''''''''''''''s husband is an engineer in cyber security industry for over ten years).

Here attached is the email sent to me suspiciously by the persons I filed restraining order with since I never receive this kind of email before I filed the restraining order.
I also received wired phone calls ever since I filed the restraining order. Since these people threatened the safety of our family, I need to report this. I would rather be safe than sorry.

仔细看了一下你写的经过，这些agent有严重的违反房地产agency law的行为。你不但要到法院告他们，而且要去加州DRE投诉，吊销这个agent和broker的执照，防止这些人出来祸害后面的客户。

这agent为了这么点钱至于吗？无法理解现在人的脑回路。
本来合作共赢的agency，一步步变为buyer 想方设法侵占agent的佣金，然后agent觉得亏了又不能说，有机会隐瞒房产缺点，瞒offer dual agent，甚至不发表自己专业看法，你说什么都是对对对只为进快成交拿更多钱的时候瞒你没商量。这种关系一步步恶化下去真的无语。
agency在美国运行了多少年涉及到各行各业。建议了解一下，然后建议大家都去要要试试，比如保险、投资、物流、运输几乎所有行业。
