排期到了 perm 还没 file 怎么办？

看到之前一个帖子回复的印度人的 loophole，用老雇主 140 file 485，等 pending 满 180 天，再 485 j port 到新雇主。


先说结论：
1）能拿到老雇主的 485 j，485 和 485 j 一起提交，就是老雇主真的同意 rehire 你，这样操作风险很小，你依然可以不去老雇主，只要新雇主也 file 485 j port 过来，这里老雇主 485j 是用来证明你不是 frivolous filing。和一般老雇主 file 485 满 180 天跳槽区别不大。


2）没和老雇主沟通，也没拿到新 offer，自己 file 485，然后等 485 pending 满 180 天后，新雇主 file 485 j，port 过来，风险很大，因为面试有几率 ref 老雇主 485 j，问到当时怎么证明老雇主仍然愿意 hire 你。

While it is not a "crime" to submit without supplement J, it may be considered a frivolous filing. If you submit the I-485 based on an I-140 from the old employer, and you do NOT have a job offer from the old employer at the time of filing (as evidenced by inability to obtain supplement J) then you are "clearly ineligible" at the time of filing which means that the filing is frivolous. While this is not a crime or an immigration violation, their attorney can be sanctioned for a frivolous filing. Furthermore, a frivolous AOS filing will NOT protect you from accruing unlawful presence if your nonimmigrant status expires while it is pending. Having a frivolous filing on your record will also subject all future applications to additional scrutiny.

感觉(2)的情况应该算得上immigration fraud. 这样铤而走险也能过的只能说走大运

你的老雇主出的485J的签字时间晚于你新雇主的开始工作时间（which你新雇主的485J上会写），你之后也没有在老雇主那里再工作，两份485J放一起也太可怕了吧

应该影响不大，只要你能有老雇主新发的 offer 以及老雇主签字的 485 j，就能说明至少当时老雇主是愿意 rehire 你你也愿意去的

另外也不知道他们是联系前雇主怎么联系的。前manager？前公司HR？前公司律所？

所以只要能说服旧雇给一个rehire的job offer就好了吗？还需要旧雇主做什么才能走方案一？感觉485都没有 旧雇主怎么直接弄485J？
