求证实…这要是真的可就xx了……

按我的理解，DHS 2008年发布STEM extension 不符合发布流程，所以这个extension被判定无效。“如果”DHS能在2016年2月之前按照规定reintroduce，则不会有影响。

On August 12, 2015, the U.S. District Court for the District of Colombia issued an opinion in the case Washington Alliance of Technology Workers vs. U.S. Department of Homeland Security, holding that the Department of Homeland Security (DHS) failed to follow proper notice and comment procedures in issuing its 2008 rule which created a 17-month extension for Optional Practical Training (OPT) in certain STEM fields. This decision invalidates the current 17-month STEM OPT extension, but stays the ruling for 6 months (allowing the existing 17-month STEM OPT extension to remain in place until February 12, 2016) in order to allow DHS to promulgate a rule restoring some version of a STEM OPT extension.......Importantly, this decision only invalidates the 2008 rule on procedural grounds. The Court found that the DHS interpretation of the F-1 regulations, allowing for the 17-month STEM OPT extension, is “not unreasonable,” noting “Congress’ broad delegation of authority to DHS to regulate the duration of a nonimmigrant’s stay and Congress’ acquiescence in DHS’ longstanding reading of F-1.” This allows DHS to reintroduce the 2008 rule or to introduce a new rule or rules for OPT. The regulatory process can be lengthy and, while DHS is likely to issue a rule soon, it should not be taken for granted that there will be any rule in place by February 12, 2016 authorizing any version of the STEM OPT extension. Employers should plan accordingly.


感觉大体意思就是说 DHS 没有及时、持续的提供足够的证据来证明STEM OPT延期是必要的，所以法院裁定延期这个政策将会在六个月之后被取消。同时，留这六个月的时间来让 DHS 有时间重新推广（promulgate）STEM OPT 延期的政策，证明它的必要性。 所以现在主要是看 DHS 怎么应对了。

最好有学法律的同学出来科普一下。。
