急！2016 OPT extension 被拒了！

      Case：OPT 17-month application
处理中心：potomac service center, 就是这位 https://www.uscis.gov/news/potomac-service-center-now-processing-certain-form-i-765-cases
Decision：08/18收到USCIS 寄来的deny notice, 原因是case was received on May 11, 该申请24个月却申请了17个月。

但是: 1, case 确实是在5/10号之前寄出去并且被delivered了的。
         2, 05/10号之前学校也只给17个月的I20, 并没有说5/10号之前必须寄到。
         3, USCIS官方并没有说明5月10号之后received的申请17个月的case要被deny

USCIS为什么不给RFE而直接给了Deny呢？应该怎么办？
请大家附上自己case的received date/是否有RFE/有没有被deny/你所在的城市，我们才好知道USCIS那边发生了什么...05/11 received - no rfe - denied - Chicago

情况有点不同， 我是 05/10 当天寄的。 ZUO！

没想到他直接denial，还现在才收到，都三个多月了。 学校当时没告诉我说5/10之前一定要寄出去（it's a ticking bomb）（他直i-2只说新的i-20一个月之内寄出去就好），USCIS也没说。现在已经过了3个月了， SEVIS status is complete， 学校DSO说 没办法发新的24月 的 I-20 了。

血淋淋的教训，工作要停的节奏， 要不然就找CPT挂靠了。

附USCIS给DSO的回信：

USCIS received the Form I-765 after May 10, 2016, on May 12, 2016. The Form I-20 filed in support of the Form I-765 application is dated April 21, 2016. The Form I-20 recommends a 17-month STEM OPT period with a start date of May 16, 2016, and an end date of October 16, 2017.

Our processing guidance for this circumstance is as follows: In the case where a Form I-765 application was filed after May 10 and the Form I-20 submitted in support of the Form I-765 recommends 17 months of employment authorization, the application will be denied.

Unfortunately, after reviewing the denial of YSCxxxxxxxxxx our processing guidance requires this application to remain denied.

USCIS regulations do not provide for an appeal of this decision. However, you may file a motion to reopen or reconsider an adverse decision.

A motion to reopen or reconsider must be filed using Form I-290B, Notice of Appeal or Motion. Form I-290B must be filed within 30 days from the date of the denial notice (33 days if this notice was received by mail) with the appropriate filing fee and other documentation in support of the motion.

Please do not send the completed Form I-290B directly to the Potomac Service Center.

信中说可以用i-290B MTR，但我觉得关键是需要新的24月的i-20。但现在太晚了， DSO 都取不出新的i-20了, 所以我的DSO告诉我不推荐MTR。（还有点贵，600+刀，据DSO说希望渺茫）（那就是没戏了）

我多花了几天准备材料就悲剧了， 他这三多月才出结果也是醉了。这新政策出台没周全考虑这期间的提交旧材料的申请人的处理，直接denial掉也算你狠。
不知道值不值得找律师呢。

my status, RFE was received on July 14 and didn't get any more response now. a little bit worried...
my original case was shipped at May 6 via Fedex overnight, so it should be delivered before May 10, but I received text message from uscis on May 12.
and due to up to 90-day ship history in Fedex account, I can't check the real delivery date. OMG!!!

check I-797 and find received date is May 09 and notice date is May 11...hope it would not have any influence...

我这边还有一个特殊的case.

这是USCIS和学校没有衔接好，所以我们一定要file motion to reopen.
这几天我天天跑学校，学校也让我们找证据证明是USCIS没有说明确。

然后大家都提交motion to reopen.

学校也联系其它学校了，基本上每个学校都有这样的学生。所以我们一定要argue到最后哈。

我人在芝加哥，请问你在哪里？我们比较担心是处理芝加哥case的人标准不一样。

人在FL， 学校在NY。
是在potomac service center处理的。标准应该一样

DSO的建议是回国，不推荐MTR 是因为现在拿不出新的24月的I-20了，过了opt expiration date 很久了。 要是能拿出新的i-20，倒是会MTR的。
请问你学校问什么建议留在美国呢？

我们学校就直接说不要回国，等最后的结果出来，他们一直在联系USCIS...
我也不知道该不该听，到时候身份黑掉了就惨了。

提交了MTR吗？身份也快失效了吧？这几天如坐针毡啊，还在上班，忙得不行不行的
