The immigration climate this year is constantly shifting and much more difficult than past years, and we have seen an increased instance of inconsistent adjudications and even denials of H-1B cap cases.  As XX has valid work authorization documents into at least mid-2018, we recommend waiting until closer to the deadline in November to respond to the RFE. This way, we can leverage the data we are gathering from the adjudication of other H-1B cap RFE responses in finalizing the response for XX to ensure that it the response is as comprehensive and robust as possible.  The response will be filed with the Immigration Service under premium processing, which will require the Immigration Service to adjudicate the responses or issue a request for further evidence within 15 calendar days of receiving our response.
