J1 waiver 未完成情况下申请 H-1B，分享一波公司律师给的信息

背景：
楼主今年首次 H-1b 抽签，当前身份为F1-OPT， 13年来美时用的 J1 签证，18年10月拿到 offer后立即开始 J1 - waiver 申请，目前进展是DOS 已向 USCIS 发出 recommendation letter，今天收到 USCIS 收据

公司律师对于我的case 给出的说明如下：

We will file your H-1B cap petition to request an automatic change of status.  We will do this under regular processing to allow more time for your J-1 Waiver case to work its way through the system.  If the government issues a Request for Evidence on your H-1B case and the waiver is still not approved, we would ask for the approval to be issued as a consular approval, which would require you to travel in the future to activate the H-1B sometime after the waiver is approved.  Please let us know if it would be helpful to further discuss.

今天来信进一步说明如下：

Before we file the H-1B cap case, I wanted to offer a final point of clarification regarding your J-1 waiver issue to make sure you understand the travel issue here.
If we file as a change of status and that request is granted, your status will change to H-1B on October 1, 2019.  You would thus need to apply for an H-1B visa in order to make new entries into the US after October 1, 2019.  You will not be able to obtain that H-1B visa until your J-1 waiver has been granted.  So the bottom line with this approach is that you will not have to travel to activate the H-1B, but you will not be able to travel abroad after October 1, 2019 until the J-1 waiver is granted.

Alternatively, we could file this as a consular case.  This means that you are free to travel on your existing F-1 status, with a valid F-1 visa.  If the H-1B petition is granted, you would need to travel to activate it by applying for an H-1B visa stamp at a US consulate abroad sometime after October 1, 2019 and before your existing status expires.  And, again, you won’t be able to obtain that H-1B visa until your J-1 waiver is granted.

我的理解是：
- 4.1 号就走正常的申请手续，即境内激活的 h1b 申请
- 收到 rfe，可以转为consular approval， 即需要回国申请visa， 并在规定期限内提交 j1 waiver
- 如果未收到 rfe，就直接等到 j1 waiver 批准以后在境内重新申请 h1b visa，期间不能离开美国

18.11.24 dos 豁免申请提交
18.12.21 纽约服务中心要求补充材料 （12.23日材料更新寄出完毕）
19.01.16 纽约服务中心初审通过， 送交领事馆教育处
19.01.22 领事馆教育处初审通过，总驻美大使馆教育处终审
19.02.26 驻美大使馆教育处终身通过， 寄出不持异议信
19.03.10 DOS收到不持异议信
19.03.12 DOS 寄出 Recommendation Letter
19.03.26 收到 USCIS 收据，显示3.10日收到 Recommendation letter

可以考虑直接申请consular h1b?我是感觉能避免rfe尽量避免rfe

lz我情况跟你一样，但我的律师是建议直接consular notification（说是have to）
