H1B RFE SO 请教需要提供的信息

关于rfe so
(2) the degree requirement is common to the industry in parallel positions among similar organizations or, in the alternative, the position is so complex or unique that it can be performed only by an individual with a degree;
请问这个信息大概要具体到什么程度，列出其他单位在网站上po出来的招聘信息，对方公司的介绍，大概需要几个呢？

(3) the employer normally requires a degree or its equivalent for the position;
我的岗位所有同事都是master学位，打算让单位出具这方面的证明，请问需要一些什么信息呢？姓名，学位，payroll，需要具体到什么程度呢？所有的同事都要写出来吗，是现在在职的同事还是包括之前雇佣过的？



如果有这些信息还有必要出具专家信吗？

我个人建立lz应该去读一下AAO的判决，这样可以帮助理解什么样的材料才不会找茬。
对于要求(2)，AAO曾经否决的上诉里面有几个通用模板：1. “While one of the vacancy announcements states that the position announced requires a bachelor's degree, it does not require a bachelor's degree in a specific specialty. Thus, that vacancy announcement does not contain a requirement of a minimum of a bachelor's degree in a specific specialty or its equivalent.” 2. "Nor does the record establish that these vacancy announcements were placed by organizations conducting business within the Petitioner's industry that are otherwise similar to it." （而且我严重感觉USCIS对industry的定义非常狭隘，我就看过某小型IT公司refer FLAG的例子被否决，说这不是parallel position因为公司industry不一样） 3. “we would still find that the Petitioner has not demonstrated what statistically valid inferences, if any, could be drawn from six announcements with regard to the common educational requirements for entry into parallel positions in similar organizations"

关于（3）“Were USCIS limited solely to reviewing a petitioner's claimed self-imposed requirements, then any individual with a bachelor's degree could be brought to the United States to perform any occupation as long as the employer artificially created a token degree requirement,  hereby all individuals employed in a particular position possessed a baccalaureate or higher degree in the specific specialty or its equivalent", "In other words, if a petitioner's degree requirement is only symbolic and the proffered position does not in fact require such a specialty degree or its equivalent to perform its duties, the occupation would not meet the statutory or regulatory definition of a specialty occupation.", "The evidence submitted is insufficient to show that these [XYZ numbers] individuals are the only people the Petitioner has employed as computer programmers in the past or that they are representative of all the people the Petitioner has thus employed. "

上面贴的太长，简述个人理解要点如下
对于（2），重要的是关键字parallel，就是说其他公司的职位必须足够接近，包括要求的经验水平，工作年限，公司大小规模，从事行业等等，要接近到别人觉得几乎一模一样才好，而且对面要求的职位必须能满足specific specialty，大忌别的公司的职位只要求BS或者MS，没有写明是某一个或者几个特定专业的BS和MS
对于（3），重要是证明公司是常年以来实实在在要本科以上学位，而不是形式化的要求本科以上学位，注意关键字token和symbolic

SO RFE和其他相比，准备起来是会比较麻烦一些，但多和HR律师沟通，尽量把自己专业的内容和工作内容match起来。

The job description should have a very detailed explanation that includes the position summary, duties, and responsibilities, as well as the percentage of time spent on each job duty. It has to be more than a dozen bullet points or a one-page description.
在网上看到这个信息，job description只需要一页就可以吗？大概要做到多具体呢？

同意楼上说的，读读AAO的裁决真的还挺有用的。关于专家信，如果需要自己准备的话，可以注意下，看到过AAO里面提到某个case里给的专家只有教学经验，没有工业界经验或者说专家没有去过你们公司，不了解你们公司的运作，所以不能成立。关于专业的话，AAO里还经常否定需要engineering本科专业的job post, 说工程可以有许多方向，不够specific

你好，我想问个小白问题。。。AAO是什么？我谷歌了一下是The Administrative Appeals Office的意思吗？这个我开了一下网站，应该在哪个选项下能看得到裁决案例呢？

还想请教一下专业specific的问题，这个怎么specific呢？是额外去突出某一个方向吗？这个真的好头疼，要是仔细看的话，我这种商科的工作确实没有非常专业到只能我做。。。自己都要没信心了

请问一下，(1)找的其他公司的职位招聘信息最好是说必须是我这个专业的BS以上，甚至是MS以上才能做最好是不？(2)关于证明公司同一职位长年要求本科以上这点，如果公司并没有这么做的话。。。是不是最好不要提交这方面信息了？

对，就是那个AAO，其实Google搜索关键字是最好的方法
专业specific，比如指明要master, major in business administration这就成为specific。如果指明只要master in business related degree，这种就不是specific。
如果不幸是后者，我的个人理解是，那么需要详细论证，为什么general business和您的专业都有specific的相关，补充说明，尽管只要master degree in general business，但是需要修过XXX课程，需要有XXX证书，需要XXX特别的技能类似，以证明尽管我的degree要求宽泛，但是具体应用在这个position上，仍然有specific requirement，这个requirement必须要本科或者以上学历才能满足，不是随便读一个商科就可以了

这个论证逻辑是这样的
1. 别人家类似/一样的岗位是符合SO的，我家的当然符合
2. 我家以前类似/一样的岗位是符合SO的，现在这个自然也符合

提交证据这事情最差也是聊胜于无，您不提交就是默认USCIS质疑的合理。私以为太伤了。
